A morte a pedido em Portugal

Abstract

A legitimidade da morte a pedido sempre foi um tópico de debate ao longo dos tempos. O grande desenvolvimento da medicina nos últimos dois séculos, feito à custa de inovações tecnológicas e científicas, alterou a forma como se vive e se morre hoje em dia. Surge a necessidade de nos adaptarmos a estas alterações. Para isso, é importante compreender o contexto histórico, em relação às ideologias mais prevalentes na nossa sociedade e à forma como se morria no passado, e também o contexto legal e deontológico português atual. Por último, e sintetizando a informação recolhida, são tecidas considerações éticas sobre a morte a pedido.Este estudo baseou-se na análise da literatura bioética atual sobre o tema, presente em livros e artigos científicos, desde o ano 2000. Para fornecer o contexto histórico, legal e social da morte a pedido, foram analisadas obras específicas sobre cada tema.O debate atual em torno da morte a pedido nas sociedades ocidentais, divido entre quem apoia a despenalização e quem é contrário, resulta do confronto ideológico entre vida e liberdade, que se vem a desenvolver já desde o final da Idade Média. Os cuidados continuados, em relação à morte a pedido, reúnem um consenso mais alargado.A evolução da medicina nos últimos séculos, paradigmaticamente exemplificada pelo aumento da esperança média de vida nas sociedades ditas ocidentais, tornou desajustada a nossa relação tradicional com a morte e com o fim de vida, exigindo, agora, que a sociedade tome medidas concretas para se adaptar a esta nova realidade.

The legitimacy of death by request has always been a controversial topic since long ago. The great development of medical sciences during the last two centuries, changed the way we live and die in this day and age. Society as a whole must choose a path to adapt to these changes. In order to do this, it’s essential we understand the historical, social and ideological background of the way we die and think about death as a society. In the second chapter, we analise the Constitution of the Portuguese Republic, the penal law and the ethical code according to the Order of portuguese doctors. The study of these documents helps to better understand the current ideological and political view of the questions concerning death by request.Lastly, we finish with ethical implications of death by request.This study is based on contemporary ethical literature, mainly books and articles, dedicated to death by request and end of life questions. For the historical, social and legal background, we dwell into specialized books on each topic. The current sides of the debate, either supporting or against death by request, follow old ideological lines of thought about the value of life and freedom that originated in the end of Medieval times. Palliative care is relatively more consensual than death by request.The development of the medical sciences in the last two centuries, epitomized by the significant increase in life expectancy in western societies, demands we make cultural changes to adapt to the new way we live and relate to death and the end of life.
