Abstract: O presente estudo tem por objeto a análise da tensão entre o Princípio Nemo Tenetur Se Ipsum Accusare (doravante denominado “PRINCÍPIO”) – o qual se manifesta mediante a proteção de direitos e garantias do acusado, figura central em um procedimento penal ou contraordenacional– e as condições legais que impõe a este a necessidade de entrega de documentos por ele produzidos e/ou arquivados, como fonte probatória nos autos, frente aos seus deveres de colaboração com a Administração Tributária.Para tanto, intenta-se delimitar os casos em que o dever de colaboração, exercido pelo contribuinte, entra em conflito com o Princípio Nemo Tenetur Se Ipsum Accusare, no contexto de uma demanda judicial, e fere sua garantia de não colaborar para a sua autoincriminação no âmbito de um processo sancionatório.A estrutura basilar para análise da presente questão se fundará em três vetores principais, são estes: (i) se o contribuinte possui, com base na garantia constituída no Nemo Tenetur, a prerrogativa de recusar-se a fornecer documentação e/ou informação que possua a partir de requerimento emitido pela Administração Tributária; (ii) a constitucionalidade das sanções aplicáveis no caso de incumprimento dos deveres de colaboração; (iii) se os documentos e/ou informações entregues em benefício da Administração Tributária, mesmo que com a condicionante de ferir o Princípio em apreço, possuem valor probatório, tanto a nível contraordenacional, quanto em sede processual penal.Projeta-se, portanto, sob a ótica da legislação em vigor, examinar a amplitude e a problemática da relativização do presente Princípio, bem como sua relação com normas de ordenamentos jurídicos internacionais, analisando o direito comparado, e com demais princípios ou garantias norteadores da questão, como a prerrogativa máxima do fair trial e o direito ao silêncio, coexistentes no ordenamento jurídico pátrio.Posto isto, intenta-se ponderar e analisar as disposições legais que versam sobre o dever de colaboração frente a Autoridade Tributária, por parte do contribuinte, em sede processual sancionatório ou contraordenacional, mais especificamente aquelas que relacionam o acusado como instrumento para a obtenção do conjunto probatório, através da entrega de documentos, e se tal papel se sobrepõe a sua função medular nos autos, qual seja, o de sujeito detentor de direitos e deveres.Neste sentido, analisar-se-á a possibilidade e implicações do acusado em recusar-se, frente a tal prerrogativa, a entregar os documentos solicitados pela Administração Tributária, pautando-se, portanto, na extensão do presente Princípio como fonte de proteção dos direitos a ele vinculados. Ademais, no cenário de uma recusa do na entrega de tais documentos, se verificará a constitucionalidade das sanções a que ele esteja sujeito, considerando a provável incidência em incumprimento do dever de colaboração.Na égide da questão, será descortinada, ainda, se a imposição de entrega de documentos no presente contexto, resulta em um conjunto probatório que mereça ser valorado, ou se o caso em apreço inviabiliza a utilização de referida prova para fins de condenação do agente. Posto isto, se fará necessário analisar o conceito, origem fundamentos legais, doutrinários e jurisprudenciais do Princípio, bem como sua amplitude e aplicabilidade do ordenamento jurídico pátrio. Também restarão analisadas as similaridades e diferenças existentes entre o direito à não autoincriminação, sob estudo, e o direito ao silêncio, que inspira e completa o primeiro. Preliminarmente, frisa-se que, apesar de intimamente relacionados, ambos os direitos trilham caminhos semelhantes, porém não paralelos, e possuem diversos pontos de intersecção em comum, sendo imperioso desdobrar o conteúdo individual e não coincidente entre estes.Não obstante, analisar-se-á o caráter relativo ou absoluto do referido princípio, e os posicionamentos doutrinários e jurisprudenciais que o contemplam. E, apesar da sedimentação pátria sobre tal questão, imperioso é expor as consequências oriundas da relativização de direitos do agente, e os riscos que este incorre por tal prática.Para elucidar a problemática em questão, tenciona-se compartilha-la em dois vetores principais, quais sejam, uma análise acerca do nemo tenetur e suas particularidades - conceituando-o de acordo com o entendimento doutrinário e jurisprudencial, apontando suas origens, fundamentos e limitações, como o cerne da questão proposta – e, em um segundo momento, tecer-se-á considerações acerca da divergência coexistente entre o dever de colaboração e a prerrogativa da não autoincriminação, plenamente aceita em território nacional, buscando uma elucidação para tal impasse.
The purpose of this study is to analyze the tension between the Nemo Tenetur Se Ipsum Accusare Principle (hereinafter referred to as the "PRINCIPLE") - which is expressed through the protection of the rights and guarantees of the accused, a central figure in a criminal or The legal conditions that impose on the latter the need for delivery of documents produced by him and / or filed, as evidentiary source in the records, against his duties of collaboration with the Tax Administration.In order to do so, it is intended to delimit cases in which the duty of collaboration, exercised by the taxpayer, conflicts with the Principle Nemo Tenetur Se Ipsum Accusare, in the context of a lawsuit, and violates its guarantee of not collaborating for its self-incrimination In the context of a sanctioning procedure.The basic structure for the analysis of this issue will be based on three main vectors: (i) if the taxpayer has, based on the guarantee constituted in Nemo Tenetur, the prerogative to refuse to provide documentation and / or information that he possesses From an application issued by the Tax Administration; (Ii) the constitutionality of the sanctions applicable in case of breach of the duties of collaboration; (Iii) if the documents and / or information submitted to the benefit of the Tax Administration, even if with the condition of violating the Principle in question, have probative value, both at the administrative and in criminal proceedings.It is therefore proposed to examine the scope and problematic of the relativization of this Principle, as well as its relationship with international legal norms, analyzing comparative law, and other guiding principles or guarantees Question, such as the maximum prerogative of fair trial and the right to silence, coexisting in the legal order of the country.Therefore, it is intended to consider and analyze the legal provisions that deal with the duty of collaboration before the Tax Authority, on the part of the taxpayer, in procedural sanctioning or contraordination, more specifically those that relate the accused as an instrument to obtain the set Evidence, through the delivery of documents, and if such role overlaps with its core function in the records, that is, the subject that holds rights and duties.In this sense, it will be analyzed the possibility and implications of the defendant to refuse, in the face of such prerogative, to deliver the documents requested by the Tax Administration, thus being based on the extension of this Principle as a source of protection of the rights To him linked. In addition, in the scenario of a refusal of the delivery of such documents, the constitutionality of the sanctions to which it is subject will be verified, considering the probable incidence in breach of the duty of collaboration.In the context of the question, it will also be established whether the imposition of documents in the present context results in a probative set that deserves to be assessed, or if the present case makes the use of such evidence unfeasible for the purpose of condemning the agent.Having said this, it will be necessary to analyze the concept, origin of legal, doctrinal and jurisprudential grounds of the Principle, as well as its breadth and applicability of the legal order of the country. There will also be analyzed the similarities and differences between the right to non-self-incrimination, under study, and the right to silence, which inspires and completes the first. Preliminarily, it is emphasized that, although closely related, both rights follow similar but not parallel paths, and they have several points of intersection in common, and it is imperative to unfold the individual and non-coincident content between them.Nevertheless, the relative or absolute nature of this principle, and the doctrinal and jurisprudential positions that contemplate it, will be analyzed. And, despite the country's sedimentation on this issue, it is imperative to expose the consequences arising from the relativization of the agent's rights, and the risks that this incurs by such practice.In order to elucidate the problem in question, it is intended to share it in two main vectors, namely, an analysis about nemo tenetur and its particularities - conceptualizing it according to the doctrinal and jurisprudential understanding, pointing out its origins, foundations and limitations , As the heart of the proposed question - and, secondly, consideration will be given to the coexistent divergence between the duty of collaboration and the prerogative of non-self-incrimination, which is fully accepted in the national territory, seeking to elucidate this impasse.
