Para uma concepção multicultural dos direitos humanos

Abstract

O artigo discute o tema dos direitos humanos a partir da observação de que, durante muitos anos após a Segunda Guerra Mundial, foram parte integrante da política da Guerra Fria, sendo como tal considerados pela esquerda, mas que, nos últimos tempos, forças progressistas dele se apossaram para reinventar a linguagem da emancipação. Para responder à indagação de se os direitos humanos podem preencher o vazio deixado pelo socialismo e se constituir como uma política emancipatória, o autor se propõe a examinar as condições para que isso se tome possível, voltando-se para a tarefa prévia de identificar as tensões dialéticas que informam a modernidade ocidental, isto é, as que se apresentam entre regulação social e emancipação social, entre o Estado e a sociedade civil e entre o Estado-nação e a globalização. Após examiná-las o autor conclui que, para que efetivamente os direitos humanos se tomem uma linguagem cotidiana da dignidade humana nas diferentes regiões do globo, é necessário um diálogo entre as diferentes culturas, ou seja, entre universos de sentido diferentes Somente por um tipo de hermenêutica que torne possível esse diálogo, os direitos humanos poderão se transformar em uma política cosmopolita que ligue em rede línguas nativas de emancipação, tomando-as mutuamente inteligíveis e traduzíveis.

The article analyses the question of human rights from the viewpoint that although after The Second World War the left wing perceived this issue as an object of the Cold War dispute, in the last years progressive actors rescued 11 in order lo reinvent the language of emancipation. With the objective of verifying the question if the human rights issue can fulfill the gap left by Socialism, that is, the lack of a policy of emancipation, the author seeks lo analyze the conditions lo make it possible. He does so by identifying the dialectic tensions that inform the Western modernity, i.e. the tensions between the social regulation and the social emancipation, the State and the society as well as the Nation-state and the globalization. His concludes by saying that for the human rights issue indeed become a language of the human dignity all over the world, it is still necessary to establish a dialogue between the different cultures, i.e. between universes of distinct meaning Moreover, the author states that only by a particular kind of hermeneutics capable of making this dialogue possible, human rights can become a cosmopolitan policy linking native languages of emancipation, mutually intelligible and translatable.
