dc.description.abstract | O presente trabalho pretende pôr em evidência a conceptualização do Planeamento Fiscal Agressivo na perspectiva da OCDE e da EU, bem como, demonstrar se a medida anti abuso, desde logo, a Cláusula Geral Anti Abuso, poderá ser eficiente no combate a práticas legais mas, inaceitáveis e imorais. A preocupação, pela reputação das multinacionais, ou seja, o risco reputacional começa a desenhar o seu caminho na sociedade. Se bem que, da perspectiva da sociedade é cada vez mais premente o pagamento da de impostos pelas multinacionais para a sustentabilidade do estado fiscal. Analisaremos os vários elementos da cláusula geral anti abuso, considerando a influência que a jurisprudência e as decisões arbitrais terão sofrido. No final apontaremos um quadro teórico para elencarmos as características que poderão assegurar a eficiência ou não das CGAA. Abstract It is the primary intention of this research, to reveal evidence on “Agressive tax Planning” conceptualizing it within the OECD and EU’s point of view, but also reveal the deeper relation with the anti-abuse measures - the GAAR. Therefore it contributes to answer and clarify the following question: “What level of efficiency is attainable by GAARs’?” Our main aim is to highlight a new perspective and provide tools to which the policy makers can address harmful tax practices to national finances – including abusive and aggressive tax practices. This study exposes several concerns about multinational opportunistic behaviour which leads to the base erosion and profit shifting.
