Abstract: Intitulada Parto anônimo: um passeio fascinante e sinuoso nos ladrilhos do Constitucionalismo luso-brasileiro, esta dissertação foi resultado de uma investigação científica que teve por objetivo verificar se há, ou não, amparo constitucional do parto anônimo no cenário luso-brasileiro, analisando os direitos que gravitam em torno da discussão, a partir dos seus titulares, e articulando, ao final, as três máximas do princípio da proporcionalidade. No início do passeio considerou-se importante resgatar a memória do instituto e verificar as marcas históricas evolutivas do abandono de crianças e das soluções implementadas pelos países selecionados (França, Itália, Portugal e Brasil), pontuando, nomeadamente, as "rodas dos expostos" e o parto anônimo, além de observar as atuais refrações da problemática no cenário mundial. A segunda paisagem desse caminho foi dedicada a analisar os direitos que envolvem a discussão, considerando o instituto como um prisma que reflete luzes, nas quais identificamos os sujeitos envolvidos (mulher, filho nascido do parto anônimo e terceiros - genitor natural, família biológica e adotiva), em um exercício analítico, que considerou os pormenores dogmáticos e jurisprudenciais e se preocupou em buscar a fundamentação constitucional luso-brasileira dos direitos compreendidos na discussão. Após a verificação sistemática de todos os direitos, partiu-se para a terceira e última apreciação, onde se deslumbrou a discussão para averiguar o acolhimento, ou não, do instituto do parto anônimo no universo constitucional, tanto do Brasil, quanto de Portugal, recorrendo aos contributos do princípio da proporcionalidade em sentido amplo, no tocante aos seus três testes constitutivos (adequação, necessidade e proporcionalidade em sentido estrito). ABSTRACT Entitled Anonymous Childbirth: a fascinating and sinuous journey through the tiles of luso-brazilian constitutionalism, this thesis resulted from a scientific investigation aiming to check the existence of constitutional support to anonymous childbirth in a lusobrazilian sphere, analyzing the rights surrounding the discussion and finally articulating the three proportionality principle’s maximum. In this journey’s beginning it was considered relevant to rescue the precept’s memory and check the child abandonment historical marks and implemented solutions by the selected countries (France, Italy, Portugal and Brazil), pointing the ‘baby hatches’ and the anonymous birth, further on observing the current world refractions of this question. The second landscape was dedicated to analyze the rights involving this discussion, considering the institution as a prism that reflects lights, in which are identified involved subjects (woman, baby born from anonymous birth and third ones – natural father, biological family and adoptive), in an analytical exercise that considered the dogmatic and jurisprudential details and bothered to search the lusobrazilian constitutional foundations of the rights in question. After the systematic verification of all these rights, it went to the third and last consideration in which the discussion was put aside to check the reception, or not, of the anonymous childbirth institution in brazilian and portuguese constitutional universes, referring to the contributes given by the proportionality principle, in its broad sense, as regards to its three constitutives tests (appropriateness, necessity and proportionality in strict sense)
