dc.description.abstractA presente dissertação pretende abordar a problemática mundial do abuso sexual de menores, perspetivando-se a intervenção pericial do médico nestas situações, as normas para a realização da perícia médico-legal e o significado dos seus resultados, bem como as implicações legais subjacentes a este procedimento. Neste sentido realizou-se uma revisão da literatura publicada sobre a incidência e a prevalência deste crime, nomeadamente em Portugal, bem como das caraterísticas do abuso sexual intrafamiliar e extrafamiliar, traçando-se o perfil do abusador, da vítima e das circunstâncias do abuso. Procedeu-se também a uma análise dos principais indicadores psicossociais e comportamentais da vítima susceptíveis de, durante a recolha de informação pelo médico, indiciar o abuso, e a uma análise das normas e procedimentos técnicos aplicados à perícia médico-legal no que diz respeito à entrevista da vítima, ao exame da superfície corporal e da região ano-genital, à recolha de vestígios forenses, ao diagnóstico e à profilaxia de infeções sexualmente transmissíveis e da gravidez nas menores adolescentes. Revelou-se importante a especial atenção do médico à história clínica que pode ser a única prova disponível, dada a elevada probabilidade de não existirem sinais ao exame objetivo ou vestígios de práticas sexuais. A não existência de sequelas físicas ou de provas forenses não significa que o crime não aconteceu. Deste modo, o testemunho do menor merece uma avaliação pela psicologia forense no intuito de valorar a sua veracidade. Em Portugal, a reforma penal de 2007 permitiu tornar o crime de abuso sexual de menores em crime público, implicando dever de denúncia a todo o cidadão que tome conhecimento do mesmo. Este procedimento visa uma adequada triagem e notificação do crime ao Ministério Público que tomará as devidas providências para investigação dos factos e para a preservação da prova. Em sede de processo-crime, o artigo 163.º do Código do Processo Penal Português atribui valor probatório à perícia médico-legal, estando, à partida, subtraído à livre apreciação do juiz. Assim, cabe ao médico a realização de uma perícia objetiva, coerente e imparcial.por
dc.description.abstractThis thesis aims to address the global problem of sexual abuse of minors, as the role of medical intervention in these cases, the rules for conducting the forensic expertise, the significance of their results, and the underlying legal implications to this procedure. To achieve this goal, we held a review of the literature on the incidence and prevalence of the crime, particularly in Portugal, as well as the characteristics of intrafamilial and extrafamilial sexual abuse, the profile of the sexual abuser as well as of the victim, and the circumstances of the sexual abuse. We also proceeded to an analysis of the major psychosocial and behavioral indicators that may indicate abuse, during the collection of information by the physician, and an analysis of technical standards and procedures applied to medical-legal expertise with regard to the victim’s interview, the examination of the body surface and the ano-genital region, collecting forensic traces, as well as diagnosis and prevention of sexually transmitted infections and teenage pregnancy. Special attention should be paid to clinical medical history, wich can be the only evidence available, given the high probability that no signs are found by the objective examination or traces of sexual practices. The absence of physical injury or forensic evidence does not mean the crime did not happen. Thus, the testimony of the child deserves a review by forensic psychology with the aim of evaluating their veracity. In Portugal, the 2007 penal reform allowed the classification of the crime of sexual abuse of minors as a public crime, implying to all citizens that take cognizance of it a duty to report. This action allows an adequate screening and reporting of the crime to the prosecutor who will set the investigation of the facts and the procedures to preserve evidence. In criminal proceedings, Article 163. º of the Portuguese Procedure Code grants probative value for the forensic expertise, standing subtracted to the discretion of the judge. Thus, the physician must accomplish an objective, consistent and impartial expertise.por
