Estudo da sugestionabilidade interrogativa em reclusos

Abstract

O presente estudo teve como objectivo analisar a sugestionabilidade interrogativa, avaliada pela Escala de Sugestionabilidade de Gudjonsson 1 (GSS1), recorrendo a duas amostras da população portuguesa, sendo uma delas constituída por 42 reclusos com várias condenações e a outra por 42 sujeitos sem contactos com sistema de justiça criminal. Pretendia-se perceber de que forma o contacto com procedimentos de inquirição usados pelo sistema de justiça criminal afecta a sugestionabilidade interrogativa, bem como a relação que se estabelece entre esta última e outras variáveis psicológicas, nomeadamente a inteligência não-verbal, neuroticismo, desejabilidade social e simulação ou esforço insuficiente. A ambos os grupos foram administrados, individualmente, além da GSS1, os seguintes instrumentos: Matrizes Progressivas Estandardizadas de Raven, Inventário dos Cinco Factores NEO, Escala de Desejabilidade Social de Marlowe- Crowne e Test of Memory Malingering. Os reclusos revelaram menor sugestionabilidade interrogativa, memória e inteligência não-verbal comparativamente aos sujeitos da outra amostra. Foram apenas observadas correlações significativas entre sugestionabilidade interrogativa e inteligência não-verbal e desejabilidade social, com características diferenciadas em ambos os grupos. Estes resultados sugerem que tais variáveis deveriam ser tidas em consideração no momento da avaliação da credibilidade de depoimentos e confissões. Contudo, é necessário que se continuem a realizar estudos que permitam utilizar a GSS como instrumento de avaliação da sugestionabilidade interrogativa validado para a população portuguesa em contexto forense.

The presente study attempted to analyze interrogative suggestibility as assessed by the Gudjonsson Suggestibility Scale 1 (GSS1) in two samples from the Portuguese population. One of them was made up of the 42 prisoners with previous convictions and the other included 42 subjects without contact with the criminal justice system. The objectives of this study were to understand how the inquiry submission procedures used by the criminal justice system affects interrogative suggestibility and what type of relationships could emerge between interrogative suggestibility and other psychological variables, namely non-verbal intelligence, neuroticism, social desirability and malingering or insufficient effort. In addition to GSS1 were administered, individually, to both groups the following instruments: Raven's Standard Progressive Matrices, NEO Five-Factor Inventory, Marlowe-Crowne Social Desirability Scale and Test of Memory Malingering. Prisoners demonstrated lower interrogative suggestibility, memory and non-verbal intelligence, when compared with the other sample subjects. Statistically significant correlations were observed between the suggestibility measures and non-verbal intelligence and social desirability, with differentiated characteristics in both groups. These results suggested that these variables should be included in credibility assessment of testimonies and confessions. However, it is necessary to continue to carry out studies that allow using the GSS as an evaluation instrument of interrogative suggestibility validated for the Portuguese population in forensic context.
