Pessoas trans, saúde reprodutiva e direitos humanos: uma revisão de literatura sobre o tema em Portugal

Abstract

Em oposição a uma história de marginalização e esterilização forçada, em 2018, o parlamento português reconheceu legalmente os processos de autoidentificação das pessoas trans, deixando de exigir prova de diagnóstico clínico ou de procedimentos de modificação corporal para alterar a identidade de género e o nome próprio de uma pessoa em documentos oficiais. A Lei da Autodeterminação do Género, possibilitou pensar os direitos reprodutivos trans, que até alguns anos eram tratados negativamente pelo Estado, afirmativamente, abrindo espaço para que pessoas trans façam escolhas reprodutivas positivamente. Através de uma revisão da literatura sobre a saúde reprodutiva das pessoas trans em Portugal, o presente trabalho identifica de que forma as pesquisas portuguesas tem visto a saúde reprodutiva de pessoas trans em Portugal após a nova legislação. Ao apontar a esterilização simbólica e a eugenia passiva que as pessoas trans sofrem, esta investigação ajuda a compreender a realidade social da saúde reprodutiva trans em Portugal para que ela possa ser melhorada e os direitos humanos das pessoas trans possam ser efetivados.

In opposition to a history of marginalization and forced sterilization, in 2018, the Portuguese parliament legally recognized the self-identification processes of trans people, no longer requiring proof of clinical diagnosis or body modification procedures to change a person's gender identity and first name on official documents. The Gender Self-Determination Law made it possible to think about trans reproductive rights, which until a few years were treated negatively by the state, affirmatively, making room for trans people to make reproductive choices positively. Through a literature review on the reproductive health of trans people in Portugal, this paper identifies how Portuguese research has viewed the reproductive health of trans people in Portugal after the new legislation. By pointing out the symbolic sterilization and passive eugenics that trans people suffer, this investigation helps to understand the social reality of trans reproductive health in Portugal so that it can be improved and the human rights of trans people can be fulfilled.
