Abstract

Entitled The Important Interconnection of the Legalization Mechanism with the Urban Rehabilitation Areas in the Local Authorities Plan - The Legalization of Illegal Buildings in Urban Rehabilitation Areas: the (possible) procedural intervention of the Municipality. The case of the Urban Rehabilitation Area of the City of Oliveira do Hospital aims, above all, to analyze and take into account the practical connection that the Legal Regime of Urban Rehabilitation (RJRU) may have with the Legal Regime of Urbanization and Building (RJUE), in the intricacies of identifying illegal buildings in an Urban Rehabilitation Area, the main objective of which is not mere identification, but resolution, through a swift procedure that manages to combine the specific procedure of protection and the restoration of urban legality, specifically through the measure of legalization, and the other procedure used in the rehabilitation of the city, which takes the form of simple or systematic urban rehabilitation operations. The aim is to understand the possible procedural intervention by municipalities, especially whether the legislator should consider creating a new mechanism designed exclusively for the specific situation presented here. The Municipality of Oliveira do Hospital deserves special recognition here, as it has created an important Urban Rehabilitation Area for the City of Oliveira do Hospital, with a dual focus on the Historic City Center and the Consolidated Area, seeking to create a balance in the overall urban dynamic.

Intitulada A Importante Interligação do Mecanismo de Legalização com as Áreas de Reabilitação Urbana no Plano das Autarquias Locais – A Legalização do Edifício em Situação Ilegal nas Áreas de Reabilitação Urbana: a intervenção procedimental (possível) do Município. O caso da ARU da Cidade de Oliveira do Hospital visa, sobretudo, analisar e atender à conexão prática que o Regime Jurídico da Reabilitação Urbana (RJRU) pode ter com o Regime Jurídico da Urbanização e Edificação (RJUE), nos meandros da identificação, em sede de uma Área de Reabilitação Urbana, de edificado em situação de ilegalidade, tendo como objectivo maior não a mera identificação mas sim a resolução da mesma, através de um procedimento célere que consiga compaginar o procedimento específico da tutela e a reposição da legalidade urbanística, concretamente através da medida da legalização, e aqueloutro utilizado na reabilitação da urbe, concretizado pelas operações de reabilitação urbanas simples ou sistemáticas. Pretende-se compreender a possível intervenção, a título procedimental, por parte dos Municípios, principalmente se deverá o legislador equacionar a criação de um novo mecanismo pensado, em exclusivo, para a concreta situação aqui exposta. O Município de Oliveira do Hospital merece aqui uma consagração especial, dado ter concretizado uma importante Área de Reabilitação Urbana, tendo por objecto a Cidade de Oliveira do Hospital, com foco dual no Centro Histórico da Cidade e na Área Consolidada, ao procurar criar um equilíbrio na dinâmica urbanística global.
