dc.description.abstract | O legislador português, pretendendo dar cumprimento às obrigações decorrentes da Diretiva 2011/93/UE do Parlamento Europeu e do Conselho, de 13 de dezembro de 2011, relativa à luta contra o abuso sexual e a exploração sexual de crianças e a pornografia infantil, e que substitui a Decisão-Quadro 2004/68/JAI do Conselho, aditou ao Código Penal, através da Lei n.º 40/2020, de 18 de agosto, o art. 176.º- B, sob a epígrafe “Organização de viagens para fins de turismo sexual com menores”.A referida neocriminalização é mais um dos sintomas de uma evolução legislativa dos crimes contra a liberdade e autodeterminação sexual marcada, essencialmente, por uma transposição pouco refletida de instrumentos de direito europeu e internacional e pela ressonância comunitária quanto à proteção penal das vítimas, em particular vítimas menores.Partindo da premissa de que a função do direito penal reside na tutela de ultima ratio de bens jurídico-penais, a presente dissertação é uma reflexão crítica em torno do tipo legal do art. 176.º- B. Assim, após algumas considerações sobre a evolução dos crimes sexuais no ordenamento jurídico português, iremos proceder a um confronto entre aquilo que a Diretiva 2011/93/UE tipifica em matéria de turismo sexual infantil e o que foi efetivamente transposto para o plano jurídico interno. dc.description.abstract | The Portuguese legislator, intending to comply with the obligations deriving from Directive 2011/93/UE of the European Parliament and of the Council of 13 December 2011 on combating the sexual abuse and sexual exploitation of children and child pornography, and replacing Council Framework Decision 2004/68/JHA, added to the Criminal Code, by means of Law no. 40/2020, of 18 August, Article 176-B, under the heading “Organisation of trips for the purpose of sex tourism with minors”.This neo-criminalisation is another symptom of a legislative evolution of crimes against sexual freedom and self-determination essentially marked by a poorly thought-out transposition of European and International Law instruments and by the collective resonance regarding the criminal protection of victims, in particular minor victims.Starting from the premise that the function of Criminal Law lies in the protection of last resort of criminal-legal goods, this thesis entails a critical reflection on the legal type of Article 176-B. Thus, after some considerations of the evolution of sexual offenses in the Portuguese legal system, we will proceed to a confrontation between what Directive 2011/93/UE typifies in terms of child sex tourism and what has actually been transposed into the domestic legal framework.
