Contudo, os tribunais ordinários possuem uma competência vinculada, sendo que estes tribunais somente podem decidir as questões de constitucionalidade que tenham por objeto as normas jurídicas que forem aplicáveis ao caso concreto submetido a julgamento. No Brasil, basicamente, são dois os dispositivos constitucionais que fundamentam o controle difuso ou incidental da constitucionalidade no sistema jurídico brasileiro: a) art. 5º, XXXV, da Constituição Federal Brasileira, que consagra o denominado princípio da inafastabilidade das decisões judiciais; e, b) o art. 97º da Constituição Federal Brasileira, que consagra e exige a observância pelos tribunais, para o controle difuso, da cláusula constitucional de reserva de plenário, ou seja, que somente pela maioria absoluta de seus membros ou de seu órgão especial, o tribunal possa declarar a inconstitucionalidade de lei ou ato normativo do poder público. Em Portugal, a previsão do controle difuso está, basicamente, nos artigos 204º e 280º, da Constituição da República portuguesa. Por isso, importante o estudo do direito comparado do controle concreto de constitucionalidade entre Brasil e Portugal, suas semelhanças e diferenças, bem como a influência de um ordenamento jurídico no outro. The Diffuse Control is a relevant theme in Brazil and Portugal, whereas the courts have direct access to the interpretation of the Constitution of the Republic and must refuse to apply the regulations that they consider unconstitutional. However, the ordinary courts have a related jurisdiction, and these courts can only decide questions of constitutionality which have as their object the legal norms that are applicable to the concrete case submitted to judgment. Basically, in Brazil, there are two constitutional devices that support the diffuse or incidental control of constitutionality in the Brazilian legal system: a) Article 5, XXXV, of the Brazilian Federal Constitution, which enshrines the so-called principle of irremovability of judicial decisions; and, b) Article 97 of the Brazilian Federal Constitution, which enshrines and requires the observance by the courts, for the diffuse control of the constitutional clause of plenary reserve, which means that only by the absolute majority of its members or of its special organ, the court can declare the unconstitutionality law or normative act of the public power. In Portugal, the provision of diffuse control is basically in articles 204 and 280 of the Constitution of the Portuguese Republic. Therefore, it is important to study the comparative law of the concrete control of constitutionality between Brazil and Portugal, their similarities and differences, as well as the influence of one legal system on the other.Keywords: Constitucional law; comparative law; control of constitutionality; Constitucionality of diffuse controlo; constitucionality of concrete provisions; brazilian constitucional legal system; portuguese constitucional legal system. |
