A UTILIZAÇÃO DE BASES DE DADOS DE PERFIS DE ADN NO PROCESSO PENAL

Abstract

A crescente utilização da ciência e da tecnologia em sede probatória na investigação criminal, designadamente, o recurso a bases de dados de perfis de ADN, tem sido utilizada na prática investigatória e na fundamentação de decisões judiciais no processo penal a nível nacional e internacional. As novas técnicas científicas que permitem obter outros tipos de informação, nomeadamente o estabelecimento de linhas genealógicas entre perfis de ADN, têm potenciado o crescimento do mercado de empresas ligadas à genealogia genética, o que facilita o acesso ao utilizador comum a análise do seu ADN e a sua eventual interconexão com outros perfis presentes nas suas bases de dados.Neste contexto surge a questão de saber se é admissível às autoridades judiciárias o recurso a estas novas técnicas e dados, ao serviço das finalidades do processo penal, em especial a realização da justiça e descoberta da verdade material, e o restabelecimento da paz jurídica comunitária, no âmbito do inquérito, tanto no decorrer deste como para desencadear a sua reabertura.A metodologia adotada foi de natureza qualitativa, baseada nas técnicas de pesquisa e análise de conteúdo documental, provenientes de diferentes fontes, como artigos doutrinais e científicos, legislação e jurisprudência relevantes para o desenvolvimento e fundamentação da presente dissertação.Pretende-se analisar a natureza jurídica das bases de dados de perfis de ADN em relação ao momento probatório; detetar as implicações que o recurso a este tipo de prova pode ter no contexto dos direitos fundamentais constitucionalmente protegidos, tomando posição sobre a admissibilidade da sua utilização no processo penal português, nomeadamente no decorrer da fase de inquérito e no desencadear da sua reabertura.

The increasing use of science and technology in evidence in criminal investigation, namely the use of DNA profile databases, has been used in investigative practice and in the reasoning of decisions in criminal proceedings at national and international level. The new scientific techniques that make it possible to obtain other types of information, namely the establishment of genealogical lines between DNA profiles, have boosted the growth of the market for genetic genealogy companies, which facilitates access for the common user to the analysis of his DNA and to its eventual interconnection with other profiles present in its databases.In this context, the question arises as to whether it is admissible for the judicial authorities to use these new techniques and data, at the service of the purposes of criminal proceedings, in particular the achievement of justice and the discovery of material truth, and the reestablishment of community legal peace, in monitoring the investigation, both during it and to participate in its reopening.The methodology adopted was of a qualitative nature, based on research techniques and analysis of documentary content, from different sources, such as doctrinal and scientific articles, legislation and relevant jurisprudence for the development and foundation of this dissertation.The aim is to analyze the legal nature of DNA profile databases in relation to the probative moment; detect the instructions that the use of this type of evidence may have in the context of constitutionally protected fundamental rights, taking a position on the admissibility of its use in Portuguese criminal proceedings, namely during the investigation phase and in the outbreak of its reopening.
