A proteção do passageiro no transporte ferroviário

Abstract

O trabalho a desenvolver versa o transporte ferroviário de passageiros, tendo como objeto de transporte as pessoas e não as mercadorias, procurando verificar até que ponto há uma real e efetiva proteção dos passageiros ferroviários nas deslocações realizadas através deste meio de transporte.A verdade é que são inúmeros os problemas que podem surgir no decurso de uma viagem ferroviária, e a generalidade dos passageiros não sabe que meios tem ao seu dispor para fazer valer os seus direitos, assim como o regime jurídico aplicável na sua proteção.O passageiro, enquanto parte mais fraca, necessita ser informado acerca dos seus direitos e, deste modo, a questão de estudo, na presente dissertação, recai sobre a proteção do passageiro, propondo-se a determinar se a lei vigente protege efetivamente os passageiros e observa plenamente os seus direitos. Deste modo, inicialmente debruçar-nos-emos a respeito dos direitos dos passageiros, analisando seguidamente o sistema de fontes aplicável, tanto a nível interno, como internacional. Posteriormente verificaremos se estamos perante um serviço público essencial, isto é, um serviço indispensável para a sobrevivência humana, e analisaremos o contrato de transporte ferroviário, examinando os seus aspetos gerais, as especificidades e o seu conteúdo. Numa vertente crítica, a presente dissertação incidirá na responsabilidade do transportador, examinando tanto o regime nacional como o comunitário, assim como a questão cada vez mais recorrente do overbooking.Por último, a exposição recairá na análise do novo regime do Regulamento comunitário, e numa breve comparação com outros ordenamentos jurídicos.

The work to be developed deals with passenger rail transport, having people and not goods as the object of transport, seeking to verify to what extent there is a real and effective protection of rail passengers when traveling by this means of transport.The truth is that there are countless problems that may arise during a rail trip, and most passengers don’t realise what means are at their disposal to enforce their rights, as well as the legal regime applicable to their protection.The passenger, as the weaker part, needs to be informed about his rights and, therefore, the question of study, in this dissertation, falls on the protection of the passenger, proposing to determine whether the law in force effectively protects passengers and fully observes their rights.In this manner, we will initially focus on the rights of passengers, and then analyze the applicable system of sources, both internal, national, and international.Subsequently, we will verify whether we are dealing with an essential public service, that is, a service indispensable to human survival, and we will analyze the rail transportation contract, examining its general aspects, specificities and content.In a critical perspective, this dissertation will focus on the carrier’s liability, examining both national and the community regime, as well as the increasingly issue of overbooking. Finally, the presentation will focus on the analysis of the new regime of Community regulation, and a brief comparison with other legal systems.
