O Dever de Cuidar dos Mais Velhos: Deveres Familiares.

Abstract

Population aging is one of the major problems of this century, allied to changes in family structures, as well in various sectors of social life. As we will see, the elderly are currently a large part of the population, but they are a vulnerable stratum of society due to various factors, therefore they need extra care.This dissertation has the objective of studying the influence of aging over the years and in today's society, in particular, in Family Law, showing the sources and principles that govern this matter. Furthermore, we will ascertain which are the family members duties towards the elderly, especially in the person of the spouse and the adult children, verifying which are the consequences that these cares bring to the families, mainly, to the women. We will also go through the figure of Family Care and the obligations that the State and the Society have towards this group. It is also essential to talk about the Obligation of Maintenance, which is incumbent on a larger cast of family members and can be an important figure for the support of the elderly, although it is not often used. We will also examine the figure of the Informal Caregiver, which has recently been recognized by Portuguese Law and which is extremely important for the elderly.Finally, we will make a parallel between the duty of care for the elderly to the duty of care for the youngest - children and teenagers, in order to verify the existing differences between the duty of parents towards minor children and the duty of older children towards their elderly parents.

O envelhecimento da população é um dos grandes problemas deste século, aliando-se às mudanças nas estruturas familiares, tal como a vários setores da vida social. Como vamos verificar, os idosos são atualmente uma grande parte da população, mas são um estrato vulnerável da sociedade devido a diversos fatores, pelo que precisam de um cuidado acrescido.A presente dissertação tem como objetivo estudar a influência do envelhecimento ao longo dos anos e na sociedade atual, em especial, no Direito da Família, mostrando as fontes e os princípios que regem esta matéria. Além disso, vamos apurar quais são os deveres dos familiares para com as pessoas idosas, principalmente na pessoa do cônjuge e dos filhos maiores, verificando quais as consequências que estes cuidados trazem para as famílias, principalmente, para as mulheres. Passamos também pela figura do Acolhimento Familiar e pelas obrigações que o Estado e a Sociedade têm para com este grupo. Torna-se ainda indispensável falar sobre a Obrigação de Alimentos, que cabe a um elenco maior de familiares e pode ser uma figura importante para o sustento dos mais velhos, embora não seja utilizada com frequência. Analisaremos também a figura do Cuidador Informal, que obteve recentemente o reconhecimento do Direito Português e que é de extrema importância para os idosos.Por fim, realizaremos um paralelo entre o dever de cuidar dos mais velhos ao dever de cuidar dos mais novos – as crianças e jovens, para verificar as diferenças existentes entre o dever dos pais para com os filhos menores e o dever dos filhos maiores para com os pais idosos.
