A utilização da imagem do jogador desportivo e a sua influência na relação laboral

Abstract

A presente dissertação tem, como escopo, a análise do direito de imagem do praticante desportivo e o seu impacto nas relações laborais.O conhecimento das leis que nos regem, dos direitos que devemos ver garantidos e dos deveres que lhes estão associados é essencial para que possamos viver numa sociedade que se pretende livre e justa. Sendo transversal a todas as modalidades desportivas, o Direito Desportivo assume um papel fundamental na organização e gestão desportiva.Assim, primeiramente, será desenvolvida a natureza jurídica do direito desportivo e a evolução histórica da legislação portuguesa, bem como a importância e a influência do desporto em todos os aspetos da sociedade.Realizada a contextualização do tema conforme à legislação, o enfoque centrar-se-á em aspetos jurídicos da exploração da imagem do atleta profissional, incluindo casos passados e casos recentes. Tentaremos demonstrar que o benefício económico decorrente da utilização de direitos de imagem é maior do que aquele que resulta diretamente da sua atividade enquanto praticante desportivo.A presente dissertação tem, pois, por principal objetivo dissecar o direito de imagem do praticante desportivo e a sua respetiva influência na relação laboral Neste sentido abordar-se-á, desde logo, os conceitos de desporto e de praticante desportivo, assim como o tratamento que a ordem jurídica portuguesa tem conferido ao direito desportivo, para de seguida nos debruçarmos sobre alguns aspetos que envolvem a relação laboral desportiva. Entraremos na temática principal desta dissertação, isto é, a relativa ao direito de imagem, o respetivo conceito e natureza jurídica, a legislação aplicável e respetiva evolução histórica, a tutela jurídica que lhe é dispensada, as repercussões que tal direito acarreta para os seus titulares no mundo tecnológico em que vivemos, com o objetivo de aferimos a forma como é configurado no domínio do desporto profissional, particularmente no que respeita à relação contratual estabelecida entre entidade empregadora e o praticante desportivo e a influência que o direito de imagem produz neste âmbito.

The scope of this dissertation is the analysis of the sportsperson's image rights and their impact on labor relations.The knowledge of the laws that rule us, the rights that we should see guaranteed and the duties associated with them is essential for us to live in a society intended to be free and fair. Being transversal to all sports, Sports Law plays a fundamental role in the organization and management of sports.Thus, firstly, the legal nature of sports law and the historical evolution of the Portuguese legislation will be developed, as well as the importance and influence of sports in all aspects of society.After the contextualization of the theme according to the legislation, the focus will be on legal aspects of the exploitation of the professional athlete's image, including past and recent cases.We will try to demonstrate that the economic benefit arising from the use of image rights is greater than the one resulting directly from one's activity as a sportsperson.The main purpose of this dissertation is therefore to dissect the image right of the sportsman and his respective influence on the employment relationship In this sense we will first of all approach the concepts of sport and sportsperson, as well as the treatment that the Portuguese legal system has given to the sports law, and then we will focus on some aspects involving the sports labor relationship. We will enter the main theme of this dissertation, that is, the one related to the right of image, its concept and legal nature, the applicable legislation and respective historical evolution, the legal protection granted to it, the repercussions that such right brings to its owners in the technological world in which we live, with the purpose of assessing the way it is configured in the field of professional sports, particularly as regards the contractual relationship established between the employer and the sportsperson and the influence that the image right produces in this scope.
