Violência Doméstica: A Emergência de um Novo Bem Jurídico ou a Reconfiguração dos Tradicionalmente Consagrados?

Abstract

A violência doméstica é, nos dias de hoje, transversal a todas e quaisquer culturas, sociedades e classes, bastando olhar atentamente para as cifras negras das vítimas e para os inúmeros estudos e estatísticas já apresentados e que muito nos fazem refletir quanto a esta temática para concluirmos pela sua pertinência e urgência.A presente dissertação de mestrado que cabe, por ora, apresentar versa sobre o tipo legal de crime de violência doméstica, previsto no artigo 152.º do Código Penal português, em especial sobre o bem jurídico-penal por ele tutelado, apenas no que contende à violência relacional íntima, perpetrada no seio conjugal ou análogo, nomeadamente em relações de namoro e de união de facto, presentes ou pretéritas. Deste modo, no primeiro capítulo compulsar-se-á todo o percurso legislativo da norma incriminadora, desde o seu surgimento com o crime de maus-tratos inicialmente previsto no Código Penal de 1982 até à última alteração da redação do artigo 152.º através da Lei n.º 57/2021, 16 de agosto. Seguidamente, analisar-se-á o tipo legal de crime de violência doméstica à luz da sua redação atual, dissecando sobre cada um dos elementos que o compõem. O último capítulo versa, então, sobre o tema que nos propusemos estudar. Assim, numa primeira instância, apresentamos o conceito de bem jurídico-penal que a doutrina portuguesa tem vindo a adotar, seguindo-se a exposição das diversas teses que vêm sendo apontadas pela doutrina e jurisprudência nacionais e internacionais. Num último momento, apresentamos aquele que nos parece ser o caminho a percorrer para a reformulação do bem jurídico-penal tutelado pelo crime de violência doméstica.

Domestic violence is, nowadays, transversal to all cultures, societies and classes, just looking closely at the black numbers of the victims and the numerous studies and statistics already presented and thar make us reflect a lot on this theme to conclude by its relevance and urgency. This master’s thesis deals with the legal type of crime of domestic violence, in the Article 152 of the Portuguese Criminal Code, in particular, on the juridical asset which he oversees, only in relation to intimate relational violence, committed in the marital or similar environment, in dating relationship and common law marriage, present or past. Therefore, the first chapter will go through the legislative path of this legal type of crime since the emergence of the crime of ill-treatment originally provided in the Criminal Code of 1982 until the last amendment of Article 152 through Law no. 57/2021, 16th august. Next, the current legal type of crime of domestic violence will be analyzed, dissected on each of the elements that compose it. The last chapter deals, then, on the subject that we set out to study. Thus, in the first instance, we present the concept of juridical asset that Portuguese doctrine has been adopting, following the presentation of various thesis that have been pointed out by national and international doctrine and jurisprudence. At the last moment, we present what seems to us to be the way forward for the reformulation of the juridical asset protected by the crime of domestic violence.
