"School Bullying- O clima de terror mascarado e a urgência da sua especial criminalização"

Abstract

The present work aims to analyse the treatment given to situations of bullying in Portugal which, over the years, has victimised thousands of children and young people in our country and throughout the world. According to the percentages of several studies and the examples of cases of violence that I here present, it can be verified that the measures taken by the competent entities, until now, have not had the desired effects. In particular, the political measures taken which have proved insufficient to achieve the goal of significantly reducing situations of violence and intimidation in the school context. Thus, I describe the subjects and the circumstances in which aggressions may occur; I examine the proposals presented so far and the mechanisms to which we may resort, seeking to remedy their shortcomings and to propose the changes I consider necessary to the future governmental project for the criminalisation of this phenomenon, which has so many negative consequences for those involved and for society itself. To this end, we must begin by recognizing this problem as the crime it is and inserting it into the legal system of each country. It is an indisputable responsibility of the State to maintain a safe and healthy environment in educational establishments, conducive to the full intellectual development of its students. The already known consequences of this behavior for the mental and/or physical health of the young people involved, and even for their school performance, demonstrate that one cannot continue to devalue and ignore these occurrences, calling them “normal things of children”, so natural and characteristic of their growth.

O presente trabalho tem como objetivo a análise do tratamento dado às situações de bullying em Portugal que, ao longo dos anos, tem vitimado milhares de crianças e jovens no nosso país e no mundo. Segundo as percentagens de vários estudos e os exemplos de casos de violência que aqui apresento, pode-se verificar que as medidas tomadas pelas entidades competentes, até ao momento, não têm surtido os efeitos desejados. Em especial, as medidas políticas proferidas, têm-se mostrado insuficientes para atingir o objetivo da diminuição significativa destas situações de violência e intimidação em contexto escolar. Assim, descrevo os sujeitos e as circunstâncias em que as agressões podem ocorrer; examino as propostas apresentadas até então e os mecanismos aos quais podemos recorrer, procurando colmatar as suas falhas e propor as mudanças que considero necessárias ao futuro projeto governamental para criminalização deste fenómeno, que traz inúmeras consequências negativas, tanto para os envolvidos, como para a própria sociedade. Para tal, devemos começar por reconhecer este problema como o crime que é e inseri-lo no Ordenamento Jurídico de cada país. É uma responsabilidade indiscutível do Estado , manter um ambiente seguro e saudável nos estabelecimentos de ensino, propício ao pleno desenvolvimento intelectual dos seus alunos. As já conhecidas consequências deste comportamento para a saúde mental e/ou física dos jovens envolvidos e, até mesmo, para o seu desempenho escolar, demonstram que não se pode continuar a desvalorizar e a ignorar estas ocorrências, apelidando-as de “coisas normais de crianças”, tão naturais e caraterísticas do seu crescimento.
