Tráfico de menores para fins de exploração sexual. Algumas considerações a propósito do lenocínio e do recurso à prostituição de menores.

Abstract

A presente dissertação foca-se na questão do tráfico de menores para fins de exploração sexual. Contudo, e antes de passarmos para a análise do tipo legal de crime, e do seu confronto com outros, como o lenocínio de menores e, consequentemente, o recurso à prostituição de menores, começamos por tentar perceber quem é, afinal, o menor. Ao longo do trabalho será abordada a temática do tráfico de pessoas, debruçando-nos, em particular, na finalidade da exploração sexual, analisando e estabelecendo um eventual concurso com o crime de lenocínio de menores, de forma, também, a tentar perceber o que é que a punição do tráfico tem a mais que a punição isolada do lenocínio, da pornografia ou do abuso sexual de menores não tem. Assim, em termos gerais, analisaremos a evolução histórica destes tipos legais de crime: tráfico de seres humanos, lenocínio de menores e recurso á prostituição de menores. Focando-nos, no entanto, e em grande parte, no bem jurídico que estes visam proteger e em toda a divergência doutrinal que caracteriza a questão. Será, também, aprofundado o tema do concurso entre o tráfico de menores e o lenocínio de menores, questão essa que, por si só, é, também, alvo de opiniões bastante divergentes. Ponto crucial ainda no âmbito do presente trabalho passa pela análise de todas as medidas de prevenção e cooperação internacional que existem e que têm como objetivo único e comum o da erradicação do tráfico de seres humanos – crime este que, pela sua natureza, põe em causa vários direitos fundamentais, neste caso, dos menores.

The present dissertation focuses on the issue of child trafficking for sexual exploitation. However, and before moving on to the analysis of the legal type of crime, and its confrontation with others, such as the pimping of minors and, consequently, the use of child prostitution, we begin to try to understand who, after all, is the minor.Indeed, throughout the work, the issue of trafficking in persons will be addressed, focusing on the purpose of sexual exploitation, analyzing and establishing a possible concourse with other legal types of crime like pimping of minors, in order to try to understand what the punishment of trafficking has that the isolated punishment of pimping, pornography or the minors sexual abuse does not.Thus, in general terms, we analyze the historical evolution of the legal types of crime: trafficking in human beings, pimping of minors and resorting to the prostitution of minors. However, focusing on the legal interest they seek to protect and on all doctrinal divergence that characterizes the issue.The concourse theme between the child trafficking and the pimping of minors will also be discussed in depth - an issue that is also the subject of quite divergent opinions. A crucial point, still within the scope of this work, is the analysis of all the prevention and international cooperation measures that exist and whose sole and common objective is the eradication of trafficking in human beings – a crime that, by its nature, into question puts in danger several minors fundamental rights.
