dc.description.abstract | Na presente dissertação, vamos numa fase inicial versar sobre a problemática respeitante à matéria das proibições de prova e a sua relevância no Processo Penal Português. Dentro deste primeiro capítulo vamos expor os princípios estruturantes do nosso processo penal relativo ao tema da matéria de prova, desenvolver o conceito de prova típica e de prova atípica, assim como a sua admissibilidade no nosso ordenamento jurídico no sentido de uma correta interpretação do art.º 125º CPP. Vamos também abordar o regime próprio e autónomo que diferencia o regime das proibições de prova, com o regime as nulidades gerais, sempre através de diferentes posições doutrinais consagradas na doutrina portuguesa. Por último, e após analisar esta matéria vamos relacioná-la com o instituto do efeito-à-distância, instituto que deriva ou é consequência da forma como o legislador não conseguiu dar solução à problemática da matéria referida supra. Para concluir, vamos identificar a consagração legal do efeito-à-distância nos Tribunais Portugueses, realizando uma análise crítica das posições jurisprudenciais do TC e do STJ.Na presente dissertação, vamos numa fase inicial versar sobre a problemática respeitante à matéria das proibições de prova e a sua relevância no Processo Penal Português.
