A DESCONSIDERAÇÃO DA PERSONALIDADE JURÍDICA DA SOCIEDADE COMERCIAL ANÁLISE DE UMA NOVA TENDÊNCIA JURISPRUDENCIAL

Abstract

Este trabalho versa sobre a problemática da desconsideração da personalidade jurídica das sociedades comerciais e pretende analisar a evolução jurisprudencial e doutrinal em relação a este tema. Nele, será dado especial enfase aos inconvenientes que o instituto gera, oferecendo-se a análise de uma nova tendência jurisprudencial que reflete os reparos que iriei enunciar e que devem operar aquando a sua aplicação. Recaindo o trabalho sobre uma temática onde existe uma multiplicidade de entendimentos, é relevante o estudo de todas aquelas que marcam o entendimento predominante em Portugal e influenciaram a minha investigação. This work verses the problem of the disregard of the legal entity of commercial companies and intends to analyze the jurisprudential and doctrinal evolution in relation to this subject.
