dc.description.abstract | A presente tese objetiva entender se as reiteradas alegações de violação de Direitos Humanos quando da implementação de legislações referentes à vacinação compulsória e as medidas restritivas e limitativas de direitos – que chamamos de discriminação sanitária – têm embasamento legal no plano do Direito Internacional dos Direitos Humanos. Influenciada pelas constantes manifestações durante o período pandêmico da COVID-19, introduz-se, em primeiro momento, o que são os Direitos Humanos e suas categorias conforme reconhecidas pelo Direito Internacional, seguindo, então, para a apresentação dos sistemas de proteção de Direitos Humanos em voga atualmente – tanto o sistema Universal das Nações Unidas quanto os sistemas regionais –, seus respectivos instrumentos normativos e particularidades. É neste momento em que os principais direitos contestados judicialmente quando da implementação das referidas medidas e legislações são abordados; é, também, o momento em que veremos brevemente a universalização e constitucionalização dos Direitos Humanos. No seguimento da apresentação destes dispositivos legais, a tese discute dois dos direitos considerados como os mais relevantes para a análise efetiva da discriminação sanitária: o direito à saúde e o direito à não-discriminação, abordando o conteúdo destes dois direitos e, especificamente no caso do direito à saúde, seu reconhecimento ou não como um Direito Humano. O caminho trilhado leva, naturalmente, para uma abordagem sobre a possibilidade e eventual previsão legal sobre limitação e restrição de direitos, além de também abordar esta restrição e limitação na prática jurídica nacional e internacional. Por fim, e objetivando entender se a discriminação sanitária é uma violação ou proteção de direitos, a tese apresenta dois case law recentes julgados dentro do âmbito do sistema regional europeu de proteção de Direitos Humanos que versam sobre a vacinação compulsória e a consequentemente limitação de direitos para os não vacinados, sendo estes casos referentes a dois momentos diferentes: o primeiro, antes do período pandêmico da COVID-19, sobre a vacinação compulsória de crianças em épocas normais; e o segundo, especificamente sobre a vacinação compulsória contra a COVID-19. | por |
dc.description.abstract | This thesis aims to understand if the repeated allegations of violation of Human Rights when legislations concerning the compulsory vaccination and measures restricting and limiting rights – which we call sanitary discrimination – are implemented have legal basis in terms of International Human Rights Law. Influenced by the constant manifestations during the pandemic period of COVID-19, it is introduced, at first, what are Human Rights and its categories, as recognized by International Law, from which, then, it follows to the presentation of the systems for the protection of Human Rights currently in vogue – the Universal system from the United Nations and the regional systems –, its respective normative instruments and its particularities. It is in this moment that the main rights judicially contested when the referred legislations and restrictive measures are implemented will be addressed; it is, also, the moment when we will briefly address the universalization and constitutionalization of Human Rights. Following the presentation if these legal provisions, this thesis discusses two of the those which are considered the most relevant rights for the effective analysis of the sanitary discrimination: the right to health and the right to non-discrimination, addressing the content of both these rights and, specifically concerning the right to health, its recognition or not as a Human Right. The path taken naturally takes us to the approach of the possibility and eventual legal provision concerning the limitation an restriction of rights, besides also addressing the said limitation and restriction during the legal national and international practice. Lastly, and aiming to understand if the sanitary discrimination is a violation or protection of rights, the thesis introduces two recent case law, tried within the scope of the European regional system for the protection of Human Rights, which deal with the matter of the compulsory vaccination and consequent limitation of right for the non-vaccinated, being these two cases referent to two different moments: the first, before the COVID-19 pandemic, about the compulsory vaccination of children during normal times; and the second, specifically about compulsory vaccination against the COVID-19. | eng |
