O Crime de Tráfico de Pessoas para Exploração Laboral- O Fenómeno da Escravatura Moderna

Abstract

This dissertation focuses on the crime of human trafficking for labor exploitation. Some evidence of the practice of this crime, the profile of victims and traffickers and the various stages of human trafficking (recruitment, transport and exploitation) will be presented.As the focus of this study is based on the labor aspect, and in these cases there is often an interconnection between the crime of human trafficking and the crime of slavery, we intend, through this study, to analyze the legal interests protected by these norms, as well as the contest problem. In addition, some shortcomings will be pointed out that we point out to articles 159.º and 160.º of the Portuguese Penal Code in charge of criminalizing these phenomena.Additionally, we will try to understand whether the way to punish cases of labor exploitation in the portuguese legal system is the most appropriate. At the same time, an allusion will be made to cases of labor exploitation that occurred in the agricultural sector in Portugal (the cases of Odemira) in order to demonstrate the precarious conditions in which the workers live and what has failed to remain in the national territory in an irregular situation, conduct which contributes to these workers being exploited. Some proposals from political parties regarding human trafficking and legislative initiatives that have emerged to combat labor exploitation in Portugal and solve some of the problems that occur on farms in Odemira will also be indicated.The world is going through a phase marked by a serious pandemic (the Covid-19 disease) and the conflict between Russia and Ukraine. In this way, reference is made to the impact that these phenomena can have on human trafficking for labor exploitation, as well as measures adopted by the European Union and Portugal to help the Ukrainian population.

A presente dissertação tem como foco o crime de tráfico de pessoas para exploração laboral. Serão apresentados alguns indícios da prática deste crime, o perfil das vítimas e dos traficantes e as várias fases do tráfico humano (recrutamento, transporte e exploração). Como a tónica deste estudo assenta na vertente laboral, e nestes casos muitas vezes observa-se uma interligação entre o crime de tráfico de pessoas e o crime de escravidão, pretendemos através deste estudo, analisar os bens jurídicos tutelados por estas normas, bem como o problema do concurso. Para além disto, serão assinaladas algumas insuficiências que apontamos aos artigos 159.º e 160.º do Código Penal Português encarregues de criminalizar estes fenómenos.Adicionalmente, tentaremos perceber se a forma de punir os casos de exploração laboral no ordenamento jurídico português é a mais adequada. Paralelamente, será feita uma alusão a casos de exploração laboral ocorridos no setor agrícola em Portugal (os casos de Odemira) de forma a demonstrar as condições precárias em que vivem os trabalhadores e o que tem falhado para permanecerem em território nacional em situação irregular, conduta que contribui para que estes trabalhadores sejam explorados. Serão também indicadas algumas propostas dos partidos políticos relativamente ao tráfico humano e iniciativas legislativas que têm surgido para combater a exploração laboral em Portugal e resolver alguns dos problemas que ocorrem nas explorações agrícolas de Odemira. O mundo atravessa uma fase marcada por uma grave pandemia (a doença Covid-19) e pelo conflito entre Rússia-Ucrânia. Desta forma, faz-se uma referência ao impacto que estes fenómenos podem ter no tráfico humano para exploração laboral, bem como medidas adotadas pela União Europeia e por Portugal para ajudar a população ucraniana.
