PORNOGRAFIA DE MENORES POR MEIOS INFORMÁTICOS

Abstract

A pornografia de menores é um crime que com os avanços tecnológicos, como a internet, vem crescendo cada vez mais e o lucro que esta gera é um atentado contra o público infantil que acontece diariamente devido ao fácil acesso a esse tipo de material através desses meios tecnológicos. Essa forma de conteúdo pornográfico contribui para o aliciamento e lesão de bens jurídicos protegidos dos menores. O Código Penal Português deve intervir nessa conduta tipificando-a como crime com a finalidade de proteger os bens jurídicos dos menores, entretanto, há diversos assuntos embasados na pornografia de menores que serão objetos de discussão na presente dissertação, como: podemos dizer que os menores de 14 anos tem direito a liberdade e autodeterminação sexual? O menor de 16 anos pode prestar um consentimento válido? Aquele que detém do material pornográfico sem intenção de divulgá-lo, distribuí-lo, exportá-lo, entre outras condutas, apenas para sua visualização, comete crime? Quando não há a presença de imagens realista de menores, mas apenas uma representação, será passível da tutela penal ou entra no âmbito da liberdade de criação artística? Existe limites quando tratamos da liberdade de criação artística? Na questão da representação realista do menor iremos abordar a pornografia aparencia, sendo aquela que adultos interpretam menores, haverá lesão ao bem jurídico dos menores? A pornografia parcialmente virtual, sendo aquela que há a representação de um menor real ou outra parte virtual, haverá crime contra o menor? Por fim, a pornografia totalmente virtual, sendo aquela que não há qualquer menor real sendo utilizado, haverá atentado contra direito dos menores? Todas essas questões serão abrangidas ao decorrer deste trabalho, por meio de análise da jurisprudência, doutrina e do regime jurídico português e, por fim, atribuir uma posição final acerca dessas discussões.

Can a minor under 16 provide valid consent? Anyone who owns pornographic material without the intention of disclosing it, distributing it, exporting it, among other conducts, just for viewing, commits a crime? When there is no realistic image of minors, but only a representation, is it liable to criminal protection or does it fall within the scope of freedom of artistic creation? Are there limits when it comes to freedom of artistic creation? On the issue of realistic representation of the minor, we will address pornography appearance, being that which adults interpret minors, will there be damage to the legal interests of minors? The partially virtual pornography, being the one that there is the representation of a real minor or another virtual part, will there be a crime against the minor? Finally, the totally virtual pornography, being that there is no real minor being used, will there be an attack on the rights of minors? All these issues will be covered in the course of this work, through an analysis of jurisprudence, doctrine and the actual portuguese legal structure and, finally, assign a final position on these discussions.
