Abstract: The objective of the article is to reflect on the political-institutional moment in Brazil and the applicability of the categories of constitutional crisis and democratic erosion in our context. First, it is necessary to go through the theoretical construction of liberal democracy and the conception of a democratic crisis. Then, the application of the theoretical categories of constitutional crisis, democratic erosion and authoritarian collapse in to the Brazilian context. Finally, the analysis of the role of the judicial review of the Federal Supreme Court in defense of democracy in the case of the arrest in flagrante delict of deputy Daniel da Silveira as a kind of militant democracy. Our hypothesis is that we have undergone a constitutional erosion revealed by the attitudes of the federal government and, however, the Federal Supreme Court acts in its own defense and in the defense of individual rights of a liberal nature. Most analytical proposals on the phenomenon of constitutional erosion are limited to verifying whether liberal rights are being protected in a given political-legal context. However, our 1988 constitutional project points to the need to build a social democracy and, thus, the category of constitutional erosion will only be applicable in our context if it covers the protection of social, cultural and economic rights. A criticism is pointed out in the jurisprudence of the Supreme Federal Court that understands democracy in a liberal sense.
O objetivo do artigo é refletir acerca do momento político-institucional do Brasil e a aplicabilidade das categorias da crise constitucional e erosão democrática em nosso contexto. Em primeiro, é necessário perpassar a construção teórica da democracia-liberal e a concepção de crise democrática. Posteriormente, problematiza-se a aplicação das categorias teóricas de crise constitucional, erosão democrática e colapso autoritário para o contexto brasileiro. Por último, a análise da atuação da jurisdição constitucional do Supremo Tribunal Federal, em defesa da democracia, no caso da prisão em flagrante do Deputado Daniel da Silveira como uma espécie de democracia militante. Nossa hipótese é que passamos por uma erosão constitucional revelada pelas atitudes do governo federal e, no entanto, o Supremo Tribunal Federal atua em defesa própria e na defesa dos direitos individuais de matiz liberal. A maioria das propostas analíticas do fenômeno da erosão constitucional buscam verificar se os direitos liberais estão sendo protegidos em um determinado contexto político-jurídico. Contudo, nosso projeto constitucional de 1988 aponta para a necessidade da construção de uma democracia social e, desse modo, a categoria da erosão constitucional somente será aplicável em nosso contexto se se abranger a proteção dos direitos sociais, culturais e econômicos. Aponta-se uma crítica à jurisprudência do Supremo Tribunal Federal que compreende a democracia em um sentido liberal.
