Abstract: No contexto de uma mudança acelerada das famílias ocidentais e de mutação do respetivo direito de família, verifica-se, em contraponto, que as políticas e os regimes jurídicos de acesso ao direito e à justiça têm uma transformação lenta (e até um retrocesso). Esta discrepância aumenta o gap entre o direito de família e das crianças e as práticas de desigualdade e de vulnerabilidade, designadamente das mulheres e crianças no espaço doméstico, pelo que os meios de acesso ao (s) direito(s) e à(s) justiça(s) e de resolução dos litígios, nesta área de conflito social, são compostos por uma pluralidade de instâncias e de atores do Estado, da Comunidade e do Mercado ou em parceria. Estes meios constituem de uma “rede” não estruturada e fragmentada e atuam como compensadores das referidas desigualdades e como fator de mudança social.
In the context of a rapid mutation of the families and of the western family law we can find, in contrast, that the policies and the legal regimes of legal aid suffer a low transformation (and even a setback). This discrepancy increases the gap between family and children law and the practices of inequality and vulnerability, particularly of women and children in the domestic space. So, access to law and justice, in this area of social conflict, are composed of a plurality of institutions and actors from State, Community, Market in partnership that constituting a fragmented network capable of compensating inequalities and acting as a factor for social change.
