Condições de trabalho em tempos de pandemia: o caso dos tribunais portugueses

Abstract

Na sequência da declaração da Organização Mundial de Saúde (OMS) sobre a COVID-19 enquanto emergência de saúde pública global, o sistema judicial português adoptou, no primeiro semestre de 2020, um conjunto de medidas para garantir das condições de segurança e saúde no funcionamento dos tribunais O principal objetivo neste artigo é analisar a adequação das respostas institucionais do sistema judicial português às condições de trabalho nos tribunais, identificando as diferentes medidas tomadas no contexto da pandemia COVID‑19 e os principais impactos no funcionamento dos tribunais. Para tal, procedeu-se à recolha e análise da legislação, orientações e normas publicadas; dos planos de intervenção nos tribunais; de notícias e de artigos de opinião nos meios de comunicação social; e de comunicados de imprensa das associações sindicais e de instituições do sistema judicial. A análise teve em consideração o período pré, durante e após o fim da primeira fase do Estado de Emergência (janeiro a junho de 2020). A análise dos dados recolhidos revelou que as medidas processuais, organizacionais, físicas e tecnológicas de resposta à COVID-19 adotadas foram fortemente condicionadas por fragilidades estruturais do sistema judicial português, exacerbando o impacto dos efeitos desta pandemia no funcionamento dos tribunais portugueses e nas condições de trabalho das profissões judiciais, com consequências especialmente negativas no desempenho funcional dos tribunais, agravando a ineficiência e a morosidade da justiça.

Following the World Health Organization (WHO) declaration of public health emergency of international concern on COVID-19, the Portuguese judicial system adopted, in the first semester of 2020, a set of measures to guarantee safe and healthy working conditions in the Courts. The main objective of the article is to analyze the adequacy of the institutional responses of the Portuguese judicial system to the working conditions in the courts, identifying the main adopted measures and impacts felt in courts functioning in the context of COVID-19 pandemic. Thus, we proceeded to the collection and analysis of legislation and regulations published by the different institutions of the judicial system, the intervention plans in the courts, online news, opinion pieces and press releases from the union associations and other official institutions of the judicial system. The analysis of institutional responses to the COVID19 pandemic took into account the period before, during and after the first phase of state of emergency (January to June 2020). The analysis concluded that the organizational, procedural, physical and technological measures adopted were strongly conditioned by previous weaknesses of the Portuguese judicial system, exacerbating the effects of this pandemic on the functioning of Portuguese courts, and on the working conditions of the judicial professions. This had particularly negative consequences on the performance of the courts, aggravating the inefficiency and slowness of justice.
