Abstract: O mundo prático é complementado em diversas vertentes pelo jurídico e, cada vez mais, é nítida a importância do direito como orientador das decisões dos profissionais de saúde.Desde há muitos anos que o consentimento informado é uma matéria muito presente, muito prática, e que se revela imprescindível para a proteção dos Direitos dos Pacientes. Esta matéria sofreu diversas evolução, desde uma vertente mais paternalista, até à atual autonomia do paciente. Mas, se é fácil e certo que podemos falar de uma verdadeira autonomia em relação a um paciente plenamente capaz, dúvidas se levantam em relação ao incapaz. O nosso estudo pretende, precisamente, tentar perceber como, e quando, poderá o doente (com algum tipo de incapacidade) decidir por si, e quem o irá substituir caso este não se encontre capaz. Após denotarmos que a Lei do Maior Acompanhado não oferece critérios orientadores no respeitante ao Direito Médico, percebemos que esta matéria, tão prática e atual, merecia um melhor desenvolvimento. Destarte, o nosso objetivo, através da análise de jurisprudência, preceitos normativos e doutrina (tanto portuguesa como estrangeira) passará por tentar oferecer respostas às problemáticas que a lei deixa por resolver; por outras palavras: dirimir as lacunas legais.Esta dissertação incidirá em problemáticas com as quais se confrontam médicos, pacientes e familiares diariamente, motivo pelo qual utilizaremos uma metodologia extremamente prática.Pretende-se refletir acerca do acompanhado, pois este é o “elo mais fraco”, principalmente quando falamos de um paciente confrontado com decisões médicas, mas também acerca do acompanhante, figura sem a qual não seria possível subsistir o regime atualmente em vigor.De forma bastante breve, poderemos afirmar que o principal objetivo do nosso estudo será averiguar se, e de que modo, é ao portador de deficiência mental concedida autonomia na hora de tomar uma decisão médica.
Our everyday life is highly complemented by the legal world, and we increasingly get to see the influence that law has when it comes to medical decisions.The aspects of the informed consent have been around for many years, and the informed consent is very important to the protection of the Patients' Rights. This subject has suffered some changes over the years, and it has evolved from the paternalism to the autonomy of the patient. But, although we can say for sure that a mentally capable patient can give informed consent, we can't say that someone with some kind of impairment will also be able to do it. With our study, we aim to understand how, and when, can a patient (with some kind of disability) decide for himself, and who will help him if he can't make the decisions because of his/hers impairment.Once we noticed that The Regime of the Accompaniment of the Major doesn’t offer criteriums to guide the acts practiced under the Medical Law, we understood that this important and practical subject deserved a better analysis. In order to find some answers, and try to fill in the lack of law, we chose to study jurisprudence, law and doctrine (both Portuguese and foreign).Because we are going to write about subjects present in the everyday life of doctors, patients and family members, our study is going to be extremely practical.We intend to reflect on the one being accompanied, as he is the weakest when it comes to a patient-doctor relationship, but we also need to talk about the companion, without whom the Accompaniment of the Major wouldn’t exist.With this paper, we aim to understand if, and how, the patient may be given the autonomy to make his/hers own medical decisions.
