Abstract: A presente investigação tem como objecto de estudo uma instituição do Estado, se hoje imprescindível, há largos séculos assinalável: o Tribunal de Contas.O primeiro capítulo procura motivar a escolha do tema, demonstrando a pertinência de uma tal discussão na actualidade. Partindo de uma não óbvia referência à construção 'Estado de Direito', descobre-se, na sua análise evolutiva, a transformação da despesa pública. Multiplicando-se as necessidades erguidas a autênticos direitos dos cidadãos, crescem os gastos da máquina administrativa, e assim a importância de um controlo. Porque os recursos são escassos, o que ainda mais se acentua no cenário de crise, como a que abalou o início do século, a premência de uma actividade de controlo sai ainda mais carregada. Por todos os cidadãos, sobretudo enquanto contribuintes.O segundo capítulo traça uma análise macroscópica, procedendo à necessária apresentação do órgão estadual que elegemos nesta pesquisa. Trata-se de um tribunal, órgão de soberania, responsável máximo pela fiscalização das despesas públicas, por isso dotado de competências de índole técnica ao lado das expectáveis jurisdicionais. Realça-se, por isso, a especialidade desta jurisdição, que justifica um corpo especial de juízes mas que é, ainda, um verdadeiro tribunal.O terceiro capítulo visa já um particular aspecto do regime jurídico que orienta a sua acção, centrando-se numa competência que se reconduz a um controlo técnico e que, simultaneamente, se defende ser exercida no âmbito de uma função jurisdicional. O foco é a fiscalização prévia, cuja grande vantagem reside na prevenção. Evidencia-se isso no caso paradigmático dos contratos públicos, expondo-se depois a tramitação processual até à decisão final, que configurará uma de três possibilidades. Para a determinar, emergem dois tipos de parâmetros.O quarto capítulo atinge o grande objectivo deste trabalho, centrando-se num desses critérios. Sem desvalorizar o mais tradicional - legalidade -, constata ser hoje imprescindível a aplicação de conceitos oriundos da economia como forma de atingir os melhores resultados para o interesse público. Procura-se, então, uma noção de boa administração, ou eficiência, e investiga-se o trajecto da sua consagração, com todos os problemas inerentes.
The object of study of this research is a state institution, not only essential today but remarkable for centuries: the Court of Auditors.The first chapter seeks to motivate the choice of the theme, demonstrating the relevance of such a discussion today. Starting from a non-obvious reference to the construction of the 'rule of law', in its evolutionary analysis one discovers the transformation of public expenditure. By multiplying the needs raised to genuine citizens' rights, the costs of the administrative machine grow, and thus the importance of control. Because resources are scarce, which is further accentuated in the crisis scenario like the one which shook the beginning of the century, the urgency of control activity is even more loaded. By all citizens, especially as taxpayers.The second chapter outlines a macroscopic analysis, proceeding with the necessary presentation of the state agency we elected in this research. It is a court, a sovereign body, most responsible for overseeing public expenditure, which makes it gather technical powers alongside the jurisdictional powers one would expect. Therefore, the specialty of this jurisdiction is highlighted, which justifies a special body of judges but is still a true court.The third chapter is concerned already with a particular aspect of the legal framework governing its way of action, focusing on a competence that leads to technical control and, at the same time, is argued to be exercised within a judicial function. The focus is on prior supervision, which major advantage lies in prevention. This is evidenced in the paradigmatic case of public procurement, then exposing the procedural process until the final decision, which will configure one of three possibilities. To determine it, two types of parameters emerge.The fourth chapter achieves the grand objective of this work by focusing on one of these criteria. Without devaluing the most traditional - legality -, it is essential today to apply concepts from the economy as a way to achieve the best results for the public interest. One then seeks a notion of good administration, or efficiency, and investigates the course of its consecration, with all the inherent problems.
