Abstract: Os instrumentos de gestão territorial em geral e o direito do urbanismo em particular, constituem-se num meio de intervenção administrativa na organização do território e concretamente no uso do solo, contribuindo para a prossecução de fins de natureza iminentemente pública , mediante uma atuação do Estado, intervencionista, proactiva, que opera na esfera do particular de forma unilateral, mas também, hodiernamente, sinalagmática . Não obstante, são característicos desta atividade estadual normativos de elevada tecnicidade e complexidade, com múltiplas cláusulas sujeitas à interpretação dos operadores [enquanto agentes da administração], as quais se podem consubstanciar em campo fértil para o surgimento de fenomenologia de índole corruptiva para a qual contribui a frequente “opacidade” que lhes é apontada. A corrupção, enquanto atividade profundamente lesiva das instituições e sociedades democráticas , desvirtua a concorrência, minando os princípios de transparência, eficácia, eficiência e prossecução da causa pública que devem constituir o primado da atuação do Estado, subtraindo recursos económicos e exaurindo, mediatamente, um amplo leque de bens públicos. Na sua estirpe urbanística apresenta “conexão íntima com a concorrência de elevadas margens de lucro apropriáveis pelos particulares, devido a um sistema de controlo ineficaz, na qual a falta de probidade e ética pública miscigenada com condutas típicas operadas pelos representantes do Estado e mais concretamente da Administração é profundamente prejudicial ao interesse público” . O presente trabalho pretende efetuar um olhar sincrético sobre as circunstâncias e fatores que propiciam a ocorrência intrínseca de fenómenos de corrupção na gestão territorial e urbanismo, suportado por uma análise interdisciplinar concretizada em factos tangíveis, demonstrativos do potencial altamente lesivo das práticas corruptivas neste universo. Partindo da correlação teórica da multiplicidade de fatores de índole diversa que concorrem para a ocorrência de corrupção urbanística e desenhando a mesma no universo do empírico, almeja-se alumiar potenciais estratégias a utilizar no combate desta atividade delituosa profundamente prejudicial à comunidade.
Urban planning law and, broadly speaking, territorial management instruments constitute a means of administrative intervention on the soil, contributing to the pursuit of purposes of an imminently public nature , through a proactive, interventionist State action that operates in a unilateral sphere, but also, today, dialectic . Nevertheless, laws and regulation of high technicality and complexity are characteristic of this state activity, with multiple clauses subject to the operators interpretation [as agents of the Administration], which can be substantiated in a fertile field for the emergence of corruption phenomenology for which contributes some “opacity ” that is pointed out to them. Corruption, as an activity deeply damaging to democratic institutions and societies, distorts competition, undermining the principles of transparency, effectiveness, efficiency and pursuit of the public cause that must constitute the primacy of the State's action, subtracting economic resources and depleting, immediately, a wide range of public goods. In its urbanistic strain, it presents “an intimate connection with the competition of high profit margins that can be appropriated by individuals, due to an ineffective control system, in which the lack of probity and public ethics miscegenated with typical conducts operated by the representatives of the State and more specifically, the Administration is deeply damaging to the public interest ”. Privileging the forensic aspect, the present exercise intends to make a syncretic look at the circumstances and factors that propitiate the intrinsic occurrence of corruption phenomena in urbanism and territorial management, supported by an interdisciplinary analysis concretized in concrete facts, demonstrating the highly harmful potential of corruption in this universe. Starting from the theoretical correlation of the multiplicity of factors of different nature that contribute to the occurrence of urban corruption and drawing it in the universe of the empirical, it aims to illuminate potential strategies to be used in combating this criminal activity deeply harmful to the community.
