Abstract: Esta pesquisa busca analisar os diferentes aspectos do direito à alimentação, bem como examinar a relação entre a sua não concretização e as práticas neoliberais. O trabalho investiga a influência dos efeitos da globalização e do atual modelo de mercado sobre a insegurança alimentar, entendendo que esta é resultante de políticas voltadas para uma maior eficiência econômica, em detrimento do respeito aos direitos humanos. Para isso, inicialmente, são analisados dados sobre o vigente panorama da alimentação no mundo, ressaltando-se aqueles apresentados pela FAO (Food and Agriculture Organization), que destaca a importância de uma alimentação adequada, sendo necessário que os Estados respeitem, protejam e satisfaçam esse direito. Além disso, foram examinados diversos tratados e pactos internacionais que apresentam diretrizes para a concretização do direito à alimentação. Desse modo, as instruções das normas de direito internacional foram observadas como um contraponto às diretivas do neoliberalismo, sendo estas apontadas como deletérias para o desenvolvimento de uma alimentação adequada para todos. Também foram analisados casos concretos, julgados por Cortes Internacionais, que evidenciam a falta de uma tradição interpretativa que compreenda a alimentação como um direito autônomo. Buscando-se compreender a origem de tal dificuldade, o segundo capítulo do trabalho observa como o desenvolvimento dos direitos humanos sempre esteve marcado por ideais liberais universalizantes, que, por vezes, não atendem às necessidades dos grupos mais vulneráveis e não garantem a dignidade da pessoa humana. Tal concepção marca, especialmente, o constitucionalismo brasileiro, que convive com constantes discursos negacionistas e ainda apresenta um longo caminho para a materialização dos direitos humanos prometidos desde a modernidade. Tendo em vista o grande abismo entre aquilo que está positivado e a prática no tocante ao direito à alimentação, a pesquisa apoia a adoção de uma teoria da constituição dirigente adequada aos países de modernidade tardia. Nesse contexto, defende-se a importância da constitucionalização do direito à alimentação como expressão de seu reconhecimento e do estabelecimento de sua obrigatoriedade imediata. Aliada a essa visão de constitucionalismo, busca-se aplicar a teoria crítica dos direitos humanos desenvolvida por Joaquín Herrera Flores. Esta teoria compreende os direitos humanos como produtos culturais, entendidos como resultados atualizáveis de lutas e conquistas sociais voltadas para as particularidades de cada comunidade. Adota-se uma postura combativa, contra-hegemônica e parcial, sempre voltada para o empoderamento das minorias. Somente o acolhimento de práticas equilibradas, contrárias à lógica de mercado do neoliberalismo globalizado, poderá garantir o respeito ao Estado Democrático de Direito. Isso certamente não pode ocorrer em uma sociedade que ainda convive com a fome e com outras formas de insegurança alimentar.
This research seeks to analyse the different aspects of the right to food, as well as to examine the relationship between the barriers to its materialization and neoliberal practices. The work investigates the influence of the effects of globalization and the current market model on food insecurity, understanding the latter as the result of politics that are more concerned with economic efficiency than with human rights. In order to do that, it analyses data on the current state of access to food and nutrition in the world, highlighting the numbers presented by the UN Food and Agriculture Organization (FAO), which show the importance of an adequate nutrition and of each State’s responsibility to respect, protect and satisfy the right to food. Moreover, several treaties and international agreements that present guidelines for the materialization of the right to food were also analysed. In this way, the instructions found on the International Law policies were observed as a counterpoint to the directives of neoliberalism, which are considered harmful to the development of adequate nutrition for every human being. Concrete cases judged by international courts were also analysed, showing the lack of an interpretative tradition that understands food as a right on its own. Seeking to comprehend the origins of such a difficulty, the second chapter of this work observes how the development of human rights has always been linked to universal, liberal ideas, that in some cases do not comply to the necessities of the most vulnerable groups and do not guarantee the dignity of human life. Such a conception is entrenched in Brazilian constitutionalism, coexisting with constant denial of the importance of human rights and with a long road ahead to their effective materialization, that has been promised since modern times. Keeping in sight the great abyss between what is present in positive law and the practice, in regards to the right to food, the research supports the adoption of a theory for a dirigent constitution adequate to the countries of late modernity. Together with this vision of constitutionalism, the work also defends the application of a critical theory of human rights, as developed by Joaquín Herrera Flores. This theory comprehends human rights as cultural products and as actualized results of social fights and conquests, in the context of each community’s particularities. As such, a combative, counter hegemonic and partial attitude is taken, turned to the empowerment of the minorities. Only the welcoming of balanced practices, contrary to the globalized neoliberalism’s market logic, will be able to guarantee the respect to the Democratic State of Law. This will certainly not be possible in a society that still has to tackle hunger and other kinds of food insecurity.
