Prova e a fundamentação das decisões judiciais em matéria de facto: breve diálogo entre o processo civil e o processo penal

Abstract

A ciência processual parece retratar o progresso da metodologia e na hermenêutica jurídica e, um dos eventos de alta complexidade está relacionado com o controlo do convencimento judicial ou convicção judicial das decisões judiciais. É necessário estabelecer uma premissa teórica que possa nortear a convicção judicial para analisa-las, corrigi-las e critica-las. Nenhum aspecto de nosso sistema está imune a críticas. Cada vez mais pessoas querem saber os preços e métodos de precificação desses sistemas, bem como, a quem eles realmente atendem. Está questão básica revela a verdadeira função do nosso sistema jurídico. Os críticos das ciências sociais podem revelar nossos aliados na mais recente fase da luta pela justiça. A definição de acesso à justiça não é fácil, mas no contexto que será utilizado nesta investigação, seu objectivo básico é garantir um sistema ou modelo que permita às pessoas justiçar seus direitos e/ou resolvê-los, sob os auspícios do Estado. A literatura sobre o este fenômeno altamente complexo que orienta a convicção ou convencimento dos juízes nos permite avaliar seu significado histórico. Com efeito, a obrigação de provar os factos em decisões judiciais deve ser rastreada de forma linear. Ao fim do trajeto de análises bibliográfica, legais e de casos concretos, tornou-se possível tecer algumas conclusões sobre a temática, nomeadamente no sentido de que o mecanismo de fundamentação das decisões em matéria de facto no processo civil e no processo penal precisam ser amplamente implementados.

It is necessary to establish a theoretical premise that can guide the judicial conviction to analyze, correct and criticize them.No aspect of our system is immune from criticism. More and more people want to know the pricing and pricing methods of these systems, as well as, who they actually serve. This basic question reveals the true function of our legal system. Critics of the social sciences can reveal our allies in the latest phase of the struggle for justice.The definition of access to justice is not easy, but in the context that will be used in this investigation, its basic objective is to guarantee a system or model that allows people to justify their rights and / or resolve them, under the auspices of the State.The literature on this highly complex phenomenon that guides the judges' conviction or certitude allows us to assess its historical significance. Indeed, the obligation to prove the facts in court decisions must be traced in a linear manner.At the end of the path of bibliographic, legal and concrete case analysis, it became possible to draw some conclusions on the subject, namely in the sense that the mechanism for substantiating decisions in matters of fact in civil and criminal proceedings needs to be widely implemented ************************************************************************************
