dc.description.abstractA presente abordagem, tendo como pressuposto a evidente limitação às Soberanias Fiscais dos Estados-Membros que tem vindo a ser levada a cabo, pelos mais diversos motivos, pela União Europeia (inter alia, pelos processos de harmonização fiscal positiva, negativa e pelo Mercado, pelas medidas de luta contra a concorrência fiscal prejudicial e pelas medidas de combate à crise financeira, com notórios impactos fiscais a nível interno), visa reflectir sobre a legitimação democrática no processo de integração fiscal da União Europeia, pretendendo determinar, concretamente, se o princípio democrático de auto-consentimento de impostos (ou de auto-imposição), fruto do ideal liberal “no taxation without representation” e tradição constitucional comum a todos os Estados-Membros, se vê cumprido ao nível da União Europeia. Destarte, após cuidada análise dos conceitos e princípios a partir dos quais construímos esta cogitação (designadamente, Soberania fiscal, legalidade fiscal, reserva de lei fiscal e princípio democrático de auto-imposição), alicerces na aferição do cumprimento do citado princípio, ao nível europeu, centramos atenções no estudo do Ordenamento jurídico da União Europeia, mormente no que respeita ao processo de integração fiscal que por si tem vindo a ser executado. Ora, considerando o facto de este processo conduzir ao condicionamento das Soberanias fiscais dos Estados-Membros e atento o sui generis contexto jurídico-institucional em que este se move, no seio da União Europeia (v.g., peculiaridade do seu sistema de fontes normativas; ausência de um princípio de separação de poderes; apontado défice democrático das Instituições europeias, particularmente do Parlamento Europeu; parcos poderes de controlo e de decisão normativa do Parlamento Europeu em matéria fiscal; deficiências ao nível do exercício da função europeia pelos Parlamentos Nacionais, não obstante os avanços conferidos pelo Tratado de Lisboa; etc.) impera determinar (mormente em termos axiológico-materiais) se, à semelhança das garantias e exigências democráticas plasmadas nas Constituições nacionais e veementemente defendidas pelos Tribunais Constitucionais nacionais (designadamente no seu confronto com o Direito da União Europeia), o Princípio democrático sai respeitado, nesta matéria e a este nível, de modo a afirmarmos que essas limitações e esses condicionamentos são democraticamente legítimos, porquanto democraticamente legitimados. Ora, perante as inúmeras dificuldades e deficiências evidenciadas nesta sede, a presente análise propugna e trilha algumas soluções, tendo por escopo, em última instância, contribuir para a efectiva consolidação, ao nível da União Europeia, dos princípios democráticos que tradicionalmente dão cor e expressão às matérias fiscais.pt
dc.description.abstractConsidering the notorious limitation to Member States´ Tax Sovereignties that, for several reasons, has been carried out by the European Union (inter alia, the positive, the negative and by the Market fiscal harmonization processes, the measures to combat harmful tax competition and the measures to combat the financial crisis, which have notorious impacts on domestic fiscal systems), the present approach aims to ponder over the democratic legitimacy of the tax integration process that has been developed at the European level, particularly intending to determine if the democratic principles on taxation (mainly those who were born from the liberal ideal “no taxation without representation”), commonly stated in all Member States´ Constitutions, are fulfilled, in practice and substance, at the European level. Thus, after a careful analysis of the concepts and principles from which we built this study (in particular, fiscal sovereignty, legality and democratic principles on taxation), attention will be focused on the analysis of the European Union´s legal system, in particular regarding the tax integration process that has been developed so far at European level. Bearing in mind the fact that this process lead to the constraint and fragmentation of Member States' Tax Sovereignties and considering the (sui generis) legal and institutional context in which it moves within the European Union (e.g., peculiarity of the European legal system and of its sources of law; absence of a principle of separation of powers; democratic deficit of the European institutions, particularly the European Parliament; meager powers of control and of law-making decision of the European Parliament, in the field of taxation; european competences deficiently developed by the National Parliaments, notwithstanding the strength of its attributions granted by the Lisbon Treaty; etc.), it is fundamental to determine whether or not, within this European process of tax integration, the democratic principles of taxation are respected by the European Union such as they are constitutionally fulfilled at the domestic level and safeguarded by national Constitutional Courts; only after this analysis one can conclude if those sovereignty restrictions on tax matters are democratically legitimate, because democratically legitimized. As so, regarding the numerous difficulties and deficiencies that this study intend to highlight, the main aim of our analysis is to track some innovative solutions and, ultimately, to contribute to the consolidation and effectiveness, at European Union level, of the democratic principles that traditionally give color and expression to fiscal matters.pt
