dc.description.abstractRESUMO O presente estudo aborda a problemática do sistema fiscal guineense em várias perspetivas, designadamente histórica, jurídica, administrativa e sociológica, visando encontrar uma resposta concertada às dificuldades que a administração fiscal e aduaneira tem enfrentado na mobilização de recursos financeiros que possam garantir a consolidação das finanças públicas e a sustentabilidade do Estado fiscal social. A conceção da versão primitiva da estrutura do sistema fiscal guineense seguiu-se à proclamação do advento da independência que, igualmente, se traduziu na instituição do Estado e a sua afirmação na cena política internacional, mantendo os impostos que vigoravam na era colonial. O período pós-independência foi largamente marcado por alterações legislativas que mais não faziam do que adequar os instrumentos herdados da antiga potência colonizadora ao contexto político, económico e social do país. A persistência da crónica instabilidade política provocou a estagnação da evolução de um regime fiscal que se encontrava na vanguarda das projetadas reformas tributárias entre os seus pares dos PALOP, ao mesmo tempo que fragilizou as instituições da República, incluindo a administração fiscal e aduaneira que se tornou órfão de qualquer capacidade institucional tendente a exploração satisfatória da base tributária existente. Os efeitos da perturbação política a que nos referimos arruinaram igualmente a dinâmica produtiva do setor privado que, de algum tempo para cá, não tem sido capaz de gerar rendimentos que permitam uma coleta significativa de recursos financeiros suscetíveis de suportar o investimento social que os desafios do desenvolvimento nos colocam e nem tão pouco garantir a consolidação orçamental. A modernização e o reforço da capacidade institucional da máquina administrativa fiscal e aduaneira apresentam uma certa possibilidade de proceder à elevação do nível da arrecadação de receitas tributárias. No entanto, este nível não proporciona ao erário público meios financeiros à altura de consolidar a sustentabilidade das finanças públicas, isto justamente porque está em causa um problema económico que se desembocou na pobreza extrema, atingindo um número significativo de agregados familiares que se revelam desprovidos de qualquer capacidade contributiva significativa.pt
dc.description.abstractABSTRACT This study addresses the problems of the Guinean tax system in various perspectives, namely historical, legal, administrative and sociological, aiming to find a concerted response to the difficulties that the tax and customs administration has faced in the mobilization of financial resources that can guarantee the consolidation of finances and the sustainability of the social tax state. The conception of the primitive version of the structure of the Guinean fiscal system followed the proclamation of the advent of independence, which also translated into the institution of the State and its affirmation in the international political scene, maintaining the taxes that existed in the colonial era. The post-independence period was largely marked by legislative changes that did nothing more than adjust the instruments inherited from the former colonizing power to the country's political, economic and social context. The persistence of chronic political instability has led to the stagnation of the evolution of a tax regime that was at the forefront of the planned tax reforms among its PALOP peers, while weakening the institutions of the Republic, including the fiscal and customs administration that became orphan of any institutional capacity for the satisfactory exploitation of the existing tax base. The effects of the political upheaval to which we refer have also ruined the productive dynamics of the private sector, which for some time now has not been able to generate incomes that allow a significant collection of financial resources capable of supporting social investment than the challenges of development and not even guarantee budgetary consolidation. The modernization and strengthening of the institutional capacity of the fiscal and customs administrative machinery present a certain possibility of raising the level of tax revenue collection. However, this level does not provide the public purse with financial means to consolidate the sustainability of public finances, precisely because it is an economic problem that has led to extreme poverty, reaching a significant number of households that are deprived of any significant contributory capacity.pt
