Abstract: Este trabalho tem por objeto a tributação ambiental e a sustentabilidade. Seu principal objetivo é analisar em que medida a tributação ambiental pode contribuir para a sustentabilidade. Decorre de uma investigação essencialmente bibliográfica à luz da doutrina luso-brasileira. Tem como principal motivação a análise dos elementos constitutivos da tributação ambiental, suas características e limitações, sua relação com a ideia de sustentabilidade e suas implicações com o setor dos transportes. O trabalho é estruturado em duas partes. Na primeira, procuramos situar a tributação ambiental no quadro da tributação em geral, fazendo uma breve explanação sobre o Estado fiscal e as funções da tributação. Observamos que a fiscalidade é a principal função da tributação, em consonância com a natureza do Estado fiscal. Entretanto, a extrafiscalidade exerce o importante papel de influenciar comportamentos sociais e econômicos. A utilização dos instrumentos tributários, ou seja, os tributos e os benefícios fiscais, com o principal objetivo de alcançar resultados extrafiscais, sobretudo econômicos e sociais, constitui um domínio jurídico próprio: o direito econômico tributário. Buscamos distinguir os tributos ambientais verdadeiros dos falsos, observando entre os primeiros quais tendem a operar na proteção ambiental: os unilaterais ou os bilaterais e quais são, na prática, os mais adequados para esse desiderato. Verificamos se nesse âmbito prevalece a tributação direta ou a indireta, a utilização dos benefícios fiscais e os limites à utilização dos instrumentos tributários na defesa do ambiente. Na segunda parte, analisamos a tributação ambiental à luz da sustentabilidade social, econômica, ecológica e a sua relação com a sustentabilidade fiscal, buscando ilustrá-la com o setor dos transportes, considerado um dos mais estratégicos nesse contexto. Ao final do estudo, são apresentadas as principais conclusões a que ele nos conduziu e as respostas aos principais problemas levantados no curso da pesquisa, tentando colaborar para o debate acerca do tema que, apesar de importante, tem sido pouco explorado pela doutrina no Brasil e em Portugal.
This work aims at environmental taxation and sustainability. Its main objective is to analyze the extent to which environmental taxation can contribute to sustainability. It follows from an essentially bibliographical investigation based on the Luso-Brazilian doctrine. Its main motivation is the analysis of the constituent elements of environmental taxation, its characteristics and limitations, its relation with the idea of sustainability and its implications with the transport sector. The work is structured in two parts. In the first, we seek to situate environmental taxation in the context of taxation in general, giving a brief explanation of taxation State and the functions of taxation. We note that fiscality is the main function of taxation, in line with the nature of the taxation State. However, extra taxation plays an important role in influencing social and economic behavior. The use of tax instruments, that is, taxes and tax benefits, with the main objective of achieving extrafiscal results, especially economic and social, constitutes a legal field of its own: tax economic law. We seek to distinguish true environmental taxes from false ones, observing among the first ones which tend to operate in environmental protection: the unilateral ones or the bilateral ones and which are, in practice, the most suitable for this desideratum. We verified whether direct or indirect taxation prevails, the use of tax benefits and the limits to the use of tax instruments in the defense of the environment. In the second part, we analyze environmental taxation in the light of social, economic and ecological sustainability and its relation with fiscal sustainability, seeking to illustrate it with the transport sector, considered one of the most strategic in this context. At the end of the study, we present the main conclusions and the answers to the main problems raised in the course of the research, trying to contribute to the debate about the theme that, although important, has been little explored by the doctrine in Brazil and in Portugal.
