Abstract: O escopo deste trabalho é compreender se há um princípio normativo capaz de fundamentar axiologicamente um caso judicativo referente à Educação Sexual. Para esse propósito, a abordagem teórica é jurisprudencialista, portanto há uma preocupação quanto à dialética valores/princípios normativos e aos limites do Direito. Há três sistemas conectados para serem avaliados: Direito, Educação e Política. Por meio desse trabalho é compreendido como significados não-jurídicos podem ou não ser juridicamente assimilados. Para isso, há três passos: primeiro, o exame de como pais, crianças e Estado podem ser posicionados nos polos suum e commune (capítulo um); segundo, as duas principais possibilidades de abordar o problema sobre direitos e deveres são analisadas com argumentos que as justificam e valores/princípios normativos que podem fundamentá-las (capítulos um e dois); por fim, são revistos os princípios normativos capazes de fundamentar axiologicamente, agora intencionando justiça prático-material (capítulo três). O resultado mais relevante foi que os três tipos de significados (jurídico, educacional e político) mantiveram sua autonomia e têm papeis importantes na composição dos seguintes sentidos: educacionalmente, a Educação Sexual não é um tipo de doutrina e ela promove o diálogo – esse é um argumento que a justifica para o Direito; politicamente, a promulgação da Educação Sexual é legítima; e, juridicamente, casos podem ser resolvidos com dois princípios normativos axiologicamente fundamentantes, a liberdade e a dignidade – enquanto a igualdade tem um significado político-jurídico incapaz de fundamentar sozinho. Ademais, também se pode concluir que a regulação da Educação Sexual pode ser juridicamente assimilada, mas não sua proibição.
The aim of this work is to understand if there is a normative principle capable of axiologically grounding a judicial case regarding Sexuality Education. For this purpose, the theoretical approach is jurisprudencialist, therefore there is a concerning about the dialetic values/normative principles and the limits of Law. There are three systems connected to be assessed: Law, Education and Politics. Throughout this work, it is understood how non-juridical meanings can ou cannot be juridically assimilated. For that, there are three steps: first, the comprehension of how parents, children and the State can be positioned in the dimensions suum and commune (chapter one); second, the two main possibilities of addressing the problem of rights and duties are analysed through claims that justify them and values/normative principles that may be their foundation (chapters one and two); finally, the normative principles capable of grounding axiologically are reviewd, now intentioning practical-substantial justice (chapter three). The most relevant outcome is that all the three types of meanings (juridical, educational and political) keep their autonomy and they play important roles in composing the following meanings: educationally, Sexuality Education is not a type of doctrine and it fosters dialogue – this is a justifying claim to Law; politically, it is legitimate the enactement of Sexuality Education; and juridically, cases can be settled with two normative principles grounding axiologically, freedom and dignity – whereas equality has a political-juridical meaning uncapable of grounding by itself. Beside that, it was also concluded that the regulation of Sexuality Education may be juridically assimilated, but its prohibition is not.
