Abstract: A dissertaçãoo é estruturada em quatro eixos jurídicos temáticos básicos que norteiam sua construção: dever constitucional, dever fundamental, nível elevado de proteção ecológica e direito fundamental ao desenvolvimento sustentável. Possui ampla discussão sobre o dever de garantir nível elevado de proteção ecológica à natureza ordinária, como direito fundamental das presentes e futuras gerações, como dever constitucional dos Estados, em uma dimensão sustentável da biodiversidade. No trabalho é destacado que a biodiversidade brasileira é riquíssima, com a presença de biomas exuberantes que possuem proteção constitucional, enquanto que outros comuns (ordinários) estão a sofrer toda a sorte de impactos antrópicos. A proposta assenta nos conceitos do NEPE, de ALEXANDRA ARAGÃO, com ampla definição de Natureza Ordinária, desenvolvida por LAURENT GODET. Essas questões são tratadas frente ao acentuado nível de degradação ambiental e das perdas da biodiversidade nos ecossistemas que estão mais próximos do homem, aquela natureza que está mais diretamente ligada ao cotidiano da sociedade e, dessa forma, necessita de um modelo jurídico de nível mais elevado de proteção ecológica, pautado por um pragmatismo e princípios morais e éticos sustentáveis. Com isso, são analisados um arcabouço jurídico e teorias que apresentam os deveres constitucional e fundamental ao desenvolvimento sustentável da natureza ordinária. Para tanto, no trabalho, defende-se a causa ambiental em uma dimensão inserida no princípio da dignidade da pessoa humana, o qual compõe o conceito de direito fundamental ao desenvolvimento sustentável intergeracional, como dever do Estado e direito humano incontestável. Nesse sentido, o estudo tem como foco compreender a proteção jurídica de natureza ordinária. No Brasil, em âmbito constitucional, tem-se a proteção da natureza exuberante, como a Mata Atlântica, a Floresta Amazônica, o Cerrado, a Caatinga, o Pantanal e os Pampas. Em Portugal, destacam-se três biomas com tutela comunitária: Região Atlântica, Região Mediterrânica e Região Macaronésica. Porém, no delineamento comparativo, o estudo aponta a proteção jurídica, de modo específico, a do Sobreiro e da Azinheira, em Portugal, presentes na região sul do rio Tejo, bem como o caso da mata dos cocais, da Pré-Amazônia, especificamente da palmeira babaçu, localizada no estado do Maranhão, Brasil. A dissertação apresenta-se com uma proposta jurídica atual, com perfil ecológico perante a atual prática socioeconômica e ambiental que viola o direito das presentes e futuras gerações. É um trabalho que corrobora para um dever constitucional fundamental de garantir o desenvolvimento sustentável que engloba a tutela de uma vida digna, no sentido de impedir condições ambientais extremas causadas por fatores antrópicos na natureza ordinária.
The dissertation is structured in four basic thematic legal axes that guide its construction: constitutional duty, fundamental duty, high level of ecological protection and fundamental right to sustainable development. It has a broad discussion about the duty to guarantee a high level of ecological protection to ordinary nature, as a fundamental right of present and future generations, as constitutional duty of States, in a sustainable dimension of biodiversity. In the paper it is highlighted that Brazilian biodiversity is very rich, with the presence of exuberant biomes that have constitutional protection, while other common (ordinary) ones are suffering all sorts of anthropic impacts. The proposal is based on the concepts of NEPE, by ALEXANDRA ARAGÃO, with a broad definition of Ordinary Nature developed by LAURENT GODET. These issues are addressed in the face of the marked level of environmental degradation and biodiversity loss in the ecosystems that are closest to man, that nature that is more directly related to the daily life of society and, therefore, needs a higher level legal model of ecological protection, guided by a pragmatism and sustainable moral and ethical principles. With this, a legal framework and theories that have constitutional and fundamental duties towards the sustainable development of ordinary nature are analysed. This is why in the work, the environmental cause is defended in a dimension inserted in the principle of the dignity of the human person, which is included in the concept of the fundamental right to the intergenerational sustainable development, as a duty of the State and incontestable human right. In this sense, the study focuses on understanding the legal protection of an ordinary nature. In Brazil, the protection of exuberant natural territories, such as the Atlantic Forest, the Amazon Rainforest, the Cerrado, the Caatinga, the Pantanal and the Pampas, are protected under the constitutional framework. In Portugal, there are three biomes with community tutelage: in the Atlantic Region, the Mediterranean Region and the Macaronesian Region. However, in the comparatively, the study points to the specific legal protection of Cork Oak and Azinheira in Portugal, present in the southern region of the river Tejo, as well as the case of the coconut forest, the Pre-Amazonia, specifically the palm tree babaçu, located in the state of Maranhão, Brazil. The dissertation presents a current legal proposal, with an ecological profile ahead of the current socioeconomic and environmental practice that violates the right of present and future generations. It is a work that corroborates a fundamental constitutional duty to guarantee sustainable development that includes the protection of a decent life, in order to prevent extreme environmental conditions caused by anthropic factors in ordinary nature.
