Abstract: A dissertação tem como objetivo traçar um estudo comparado entre os ordenamentos português e brasileiro, sobre a evolução do reconhecimento da filiação, dando ênfase para aquele ocorrido no âmbito do Registro Civil. Foi realizada a análise do tema e a sua evolução a partir da última década de setenta até agora, quando começou-se a deixar de lado o conceito de legitimidade e passou-se àquele de igualdade dos filhos, para, em seguida, ampliar a interpretação do chamado “superior interesse da criança”, o que levou no Brasil à inovadora aceitação da chamada “Multiparentalidade”, inclusive atualmente facilitada por seu procedimento realizado diretamente pelo Registrador Civil das Pessoas Naturais. A pesquisa foi feita por meio da lei, doutrina e jurisprudência de ambos os Países (Portugal e Brasil) para o estabelecimento do vínculo de filiação, com especial atenção para aqueles voluntários ocorridos em sede extrajudicial e para os casos nos quais não há maternidade ou paternidade estabelecida no registro de nascimento inicial. Os casos de reconhecimento voluntário de perfilhação perante o registro civil, a averiguação oficiosa e as recentes alterações legislativas Portuguesas (Lei n. 32/2006 PMA e n. 143/2015 – adoção) e Brasileiras (Provimento n. 16 de 17/02/2012 e n. 63 de 14/11/2017 do Conselho Nacional de Justiça), que permitiram o reconhecimento de paternidade biológica e “socioafetiva” perante o RCPN brasileiro, com a consequente configuração da multiparentalidade. A ideia central de que Portugal, apesar de ainda privilegiar o critério biologista, com a introdução da legislação referente à adoção e daquela que tratou das técnicas de PMA, passou a aceitar a concorrência do critério da vontade para a determinação da parentalidade e, assim, ampliou sua gama e hoje aceita a afetividade como formadora do vínculo de parentesco. O paralelo realizado entre os dois sistemas, permite ao leitor entender as principais diferenças, em especial o relevo concedido à afetividade no Direito Brasileiro, o foco no chamado “superior interesse da criança” e a simplificação do procedimento da perfilhação, seja ela biológica, seja afetiva, no âmbito extrajudicial, por meio da confiança depositada no ORCPN pelo Ordenamento Brasileiro. Por fim, apresenta-se a ideia de um novo procedimento, a ser introduzido no âmbito da Conservatória do Registo Civil, a exemplo do que ocorre no Brasil, para que se reconheça o instituto da filiação sociafetiva em Portugal, pois distinto da adoção, seja em seus pressupostos, como em seus efeitos.
This dissertation is a comparative study between the Portuguese and Brazilian legal systems regarding the evolution of the recognition of parental affiliation, with a particular emphasis on how this process has been legally recognized by the Civil Registry. The dissertation analyses the development of the recognition of parental affiliation and its evolution from the 1970s to date, where the concept of legitimacy started being left aside, in favour of the concept of equality of children, which then led to the further broadening of this concept to include assessment of the best interests of the child. In Brazil, this evolution led to the innovative development and acceptance of the so-called "Multiparentality", which is now facilitated by procedures carried out directly by the Official of Civil Registration. The research was carried out through an in-depth analysis of the law, doctrine and jurisprudence of both countries Portugal and Brazil to establish the bond of parental affiliation, with special attention placed on those individuals who informally and extrajudicially accepted parenthood of the child(ren), where no maternity or paternity was formally recorded on the initial birth record/certificate. In the cases of voluntary recognition of legal status before the civil registry, the unofficial inquiry and the recent Portuguese legislative reforms (Law 32/2006 PMA and n. 143/2015 - adoption) and Brazilian legislation (“Provimento” n ° 16 of 17/02/2012 and n. 63 of 14/11/2017 of the National Council of Justice), have allowed the recognition of parenthood to be based on both biological and "socio-affinity" grounds before the Brazilian Civil Registry, a term which has been coined “multiparentality.” The Portuguese approach, although still privileging the biological criterion through the introduction of legislation regarding adoption and the techniques of PMA, has been to concurrently accept the concept of the “will” of the individual to accept and therefore determine parenthood without biological ties to the child, and this has transformed and widened the concept of parenthood and kinship in the country. The parallel made between the two legal systems allows the reader to also understand the main differences, especially with regards to the emphasis on affinity in Brazilian law and the so-called "best interests of the child" and the simplification of the procedure to recognize parenthood, whether biological or affective, which was established by extrajudicial procedures through the trust deposited in the Official of Civil Registration by the Brazilian legislation. Finally, the dissertation concludes by presenting a newly emerging procedure to be introduced by the Civil Registry in Portugal to recognize the Brazilian concept of "socio-affinity" parenthood (or affiliation), which is different from adoption in its assumptions, and in its effects.
