dc.description.abstractDo desenvolvimento das Tecnologias da Informação e da Comunicação, advieram profundas alterações na forma como a sociedade e a economia se configuram, na medida em que, passámos de uma economia assente em pilares tradicionais, em que é requisito a existência de presença física, para uma economia que se realiza plenamente através de meios digitais.No seio dessas alterações, e tendo como elemento propulsor o mundo digital, foram surgindo novos modelos de negócio, que nos foram dados a conhecer com os Relatórios do Plano de Acção BEPS (mais precisamente, com o Relatório da Acção 1), em tudo diferentes do que os que sempre conhecemos, de entre os quais, se encontram os Digital Influencers. Um negócio que, não obstante, ainda, se encontrar em fase de desenvolvimento, já tem um impacto colossal, nomeadamente, a nível das receitas que gera.Ora, perante a celeridade com que surgem estas novas realidades, o legislador fiscal tem manifestado grandes dificuldades em acompanhá-las, pelo que, muitas situações têm ficado por regular.Nessa medida, a presente investigação, focando-se na temática dos Digital Influencers, tem como principal objectivo tentar compreender de que forma o legislador fiscal pode adaptar as normas jurídicas vigentes a esta nova realidade, de forma a que não exista uma falha de tributação, crucial para a erosão das bases tributárias do país.E, não obstante, se tratar de um fenómeno nascido no seio da globalização, apenas nos iremos centrar na sua perspectiva interna, isto é, apenas nos iremos mover por entre o ordenamento jurídico português.por
dc.description.abstractThe development of Information and Communication Technologies has led to profound changes in the way in which society and the economy form, since we have moved from an economy based on traditional pillars, where physical presence is required to an economy that is fully realised through digital means.Within these changes, and with the digital world as a driving force, new business models have emerged, which we have been made aware of in the BEPS Action Plan Reports (more precisely, with Action 1 Report) different in every way from what we have always known, among which are the Digital influencers. A business that, even though it is still under development, already has a colossal impact namely on the revenue it generates.However, given the speed with which these new realities arise, the tax legislator has been finding it very difficult to keep up with them, and many situations have therefore remained unregulated.To that extent, the main objective of this research, focusing on the issue of Digital influencers, is to try to understand how the tax legislator can adapt the current legal rules to this new reality, so that there is no tax loophole, which is crucial to the erosion of the country’s tax bases.Even though it is a phenomenon born within globalisation, we will only focus on its internal perspective, that is, we will only move within the Portuguese legal order.----------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------eng
