Sentidos e valores penais na contemporaneidade: a busca dos elos de pensamento necessários entre media e justiça criminal

Abstract

A investigação no âmbito da comunicação e dos media, por um lado, e do crime e da justiça criminal, por outro, tem investido na compreensão das relações existentes entre os seus objetos de estudo. Este tem sido, porém, um investimento marcado pelo descaso recíproco, senão mesmo pela desconfiança mútua, apesar de partilharem influências teóricas e metodológicas e preocupações intelectuais. Neste artigo, trazemos à colação algumas teorias sobre os sentidos e valores penais que, ao interessarem-se pelas questões da justiça, da comunicação e da cultura e com o lugar dos media no sistema social, têm contribuído para aproximar estas áreas de estudo. Realçando a pertinência dessas propostas, demonstraremos a imprescindibilidade deste pensamento para melhor entender e dirimir as tensões entre os media e a justiça. Fá-lo-emos em particular enunciando os resultados de dois estudos empíricos da mediatização de processos de reforma legal baseados em análises de imprensa.

Research in the area of communication and media, on the one hand, and in crime and criminal justice, on the other, has been investing in understanding the relationship between their subjects of study. This has been, however, an investment marked by mutual disregard, if not by mutual distrust, despite sharing theoretical and methodological influences and intellectual concerns. In this article, we bring into play some theories about criminal values and senses, whose interest in issues of justice, communication and culture and in the place of the media in the social system, have helped to bring together these areas of study. By emphasizing the relevance of these proposals, we demonstrate the indispensability of this thinking to better understand and resolve the tensions between media and justice. We will do it in particular stating the results of two empirical studies of media coverage of cases of legal reform based on press analyses.
