Abstract: Vivemos uma realidade em que muitos pensavam que a religião estaria, a essa altura, totalmente superada pelo secularismo, e que as crenças individuais não afetariam mais o percurso do mundo. Contudo, ocorre um movimento contrário, e que não pode ser ignorado. Constatam-se cada vez mais pessoas que buscam uma autoafirmação religiosa, e ao mesmo tempo isto vem sendo estimulado pelo aumento do multiculturalismo advindo da imigração para os Estados europeus. A receptividade ocidental é fria: busca afastar a religião do espaço público, isolando-a no âmbito privado de cada ser humano, sendo conivente apenas com os componentes envolventes da religião majoritária, devido ao vínculo histórico-cultural. Porém, este quadro vem gerando incessantes conflitos de não conformação com estas normas seculares. À vista disso, para compreender melhor esta nova dinâmica europeia elegemos o estudo de decisões pontuais promulgadas pelo Tribunal Europeu de Direitos do Homem que envolveram os símbolos religiosos nas instituições públicas de ensino. Tal critério foi utilizado, devido aos símbolos serem capazes de demonstrar de forma clara a crise secular atual, pois através dos julgados do Tribunal e da análise das particularidades e legislações internas dos Estados, veremos as diferentes conotações e tratamentos dados ao lenço islâmico – símbolo utilizado pela minoria religiosa muçulmana – e ao crucifixo – símbolo da maioria religiosa católica -. A escolha pelo ambiente educativo se deve por ele ser um local onde podemos conferir a dinâmica social de forma mais restrita, como o papel do Estado e conjuntamente experimentar as soluções mais adequadas. Posto isto, compreender a liberdade religiosa, seus desdobramentos históricos e como ela está definida na Convenção Europeia de Direitos Humanos é o primeiro passo para os seguintes que irão ser percorridos através das decisões selecionadas. Por fim, o presente estudo demonstra a necessidade de se repensar a forma de interpretação e tratamento dos símbolos religiosos, o que se requereria uma adaptação do secularismo, apoiado num modelo de valorização da diversidade, de integração da pluralidade religiosa no espaço público e de um TEDH que reflita estes fatores e que seja fortemente comprometido com a tolerância para harmonização social em prol da igualdade e do respeito entre todos.
We live in a reality in which many people thought that religion would be, by this point, totally overcome by secularism, and that individual beliefs would no longer affect the course of the world anymore. However, a contrary movement occurs, and cannot be ignored. People, more and more each time, are flagrant in searching for a religious self-affirmation, and at the same time this has been stimulated by the rise of multiculturalism as a result of immigration towards European states. Western receptivity is cold: it seeks to cast away religion from the public space, isolating it in each human being private sphere, conniving only with the components involved in the majority religion, due to its historic and cultural bond. However, this picture has been generating conflicting interests of non-conformation to those secular rules. In light of that, in order to better understand this new European dynamic, we elected the study of punctual decisions promulgated by the European Court of Human Rights, that involved religious symbols in public teaching institutions. Such criteria was chose due to those symbols been able to clearly demonstrate the current secular crisis, cause through the cases judged by the Court and the analysis of the States’ internal particularities and legislations, we’ll see the different treatments and connotations that are given both to the Islamic scarf – symbol utilized by the Muslim religious minority – and to the crucifix – symbol of the catholic religious majority. The choice for the educational environment is due to its being a place where we can check the social dynamic in a more restricted form, as for the State’s role, and altogether to experiment the more adequate solutions. That being said, to understand the freedom of religion, its historical unfolding and how it is defined in the European Convention of Human Rights is the first step to the following that will be covered through the selected decisions. At last, the present study demonstrate the necessity to rethink the form of interpretation and treatment of religious symbols, which would require an adaptation of the secularism, based on a model of diversity’s appreciation, of religious plurality’s integration in a public space, and in a Court that reflect those factors and that is strongly committed to tolerance for social harmonization in favour of equality and respect among all.
