Abstract: A presente dissertação prende-se com a problemática da Alienação Parental e do Contacto do Menor com a Família Alargada. Ao longo da mesma, procedemos à destrinça entre os conceitos de “Síndrome de Alienação Parental” e “Alienação Parental”, expomos uma visão crítica sobre a (In)Admissibilidade da Teoria da Síndrome de Alienação Parental, bem como clarificamos formas de identificar um processo de Alienação Parental.Com o presente trabalho analisamos ainda os fenómenos associados ou associáveis ao processo de alienação parental. Igualmente premente será perceber como prevenir um processo de Alienação Parental (apresentando para isso Sinais de Alerta), bem como reprimi-lo (no seu decurso), nomeadamente com a utilização do Novo Regime Geral do Processo Tutelar Cível (incumprimento da sentença de regulação do exercício das responsabilidades parentais- art. 42º), e ainda o art. 249º nº1 al.c) do Código Penal, sobre o Crime de Subtracção de Menores. Na presente dissertação alertamos ainda para a ausência de uma lei específica sobre Alienação Parental(que já existe no Brasil com a Lei nº12.318 de 26 de Agosto de 2010), sendo cada vez mais premente a inclusão, no sistema jurídico português, de uma lei especialmente dedicada à temática em análise. Com a dissertação que ora nos ocupa, logramos ainda proceder à densificação do conceito de “Família Alargada”, que é mais extenso que o conteúdo do art. 1887º-A CCivil, sendo esta realidade que nos leva a propor um estudo in casu e a criticar a actual delimitação legal. A importância dos Tribunais de Família e Menores, dos advogados, do Ministério Público e das equipas multidisciplinares, bem como da Mediação Familiar, são ainda alvo de análise ao longo deste trabalho.Entre outras evoluções legislativas abordadas ao longo do presente trabalho, abordamos ainda a entrada em vigor da Lei nº137/2015 de 7 de Setembro (que vem aditar o art. 1904º-A ao Código Civil Português), e assim proceder à extensão do exercício das responsabilidades parentais à figura do padrasto/madrasta e suas vicissitudes.
The present dissertation addresses the issue of Parental Alienation and the Contact of the Minor with the Extended Family.In this dissertation, we distinguish the concepts of "Parental Alienation Syndrome" and "Parental Alienation", expose a critical view on the (non)Admissibility of Parental Alienation Syndrome Theory, and also clarify ways of identifying a Parental Alienation process.With the present dissertation we also analyze other behaviour/conditions which are or may be associated with a parental alienation process.Equally pressing will be to better understand how to prevent the Parental Alienation process and clarify its “warning signs”, as well as repress it (during its course), namely with the use of the portuguese Family and Children´s Law (Novo Regime Geral do Processo Tutelar Cível) and its consequences on the non-compliance with the sentence of regulation of the exercise of parental responsibilities- article 42º. The article 249º nº1 c) of the Penal Code (adressing the Crime of Child Abduction) is also analyzed as a response to a Parental Alienation Process.In the present dissertation, we also alert to the absence of a specific law on Parental Alienation (which already exists in Brazil- Law No. 12.318 of August 26, 2010). A specific law adressing Parental Alienation must be included in the portuguese legal system. We also aim to densify the concept of "Extended Family", which is composed by more family elements than the ones the art. 1887º-A of the Civil Code presents. Due to this fact, we defend a more casuistic study, by identifying (in each specific case) who really is a reference to the minor and thus must be recognized with a right of visit. The importance of the Family and Juvenile Courts, the lawyers, the Public Prossecutor’s Office and the multidisciplinary teams, as well as Family Mediation, are also analyzed throughout this dissertation.Among other legislative developments addressed throughout the present dissertation, we also approached the entry into force of the Law no. 13/2015 of September 7 (which adds the article 1904-A to the Portuguese Civil Code), and thus enables the extention of the exercise of parental responsibilities to other family figures (step-parents).
