Abstract

The scope of this dissertation focuses on the Cohabitacion relationship analisys, and through it we intend to contribute in some way to the discussion about the admissibility of the members of a cohabitacion relationship benefit from certain property effects, as in the case of marriage, as a matter of legal certainty. This is because, although the members of a cohabitacion relationship have a relationship which is in practice analogous to that of the spouses, in reality these relations offer them only some social protection, despite the growing concern of the legislature to regulate the Cohabitacion relationship. In fact, members of cohabitacion relationship may enjoy some similar effects to those of the spouses, but unlike in other countries, they are not equated with them.In fact, this dissertation proposes the possibility of the members of a cohabitacion relationship being able to regulate the property effects of relations between them and with third parties, through a contract, subject to registration.To do so, we will analyze the cohabitacion relationship and marriage, as well as the respective effects of each. Then we will make a brief reference to comparative law, and also to the contours of the presidential rejection of the "Dec.-Lei n.º 349/X", which aimed the attribution of some property effects to the members of cohabitacion relationships. Lastly, we will make a proposal to regulate the property effects of the cohabitacion relationship, by means of a contract, subject to registration, giving them some rights similar to those of the spouses, in order to offer them greater legal certainty, and also to those who with them hire.

A presente dissertação tem como escopo a análise da União de Facto, pretendendo-se através dela contribuir para a discussão da possibilidade de os membros da União de Facto virem a beneficiar de alguns efeitos patrimoniais, à semelhança do que acontece no casamento por uma questão de segurança jurídica. Isto porque, apesar de os unidos de facto terem uma relação na prática análoga à dos cônjuges, na realidade estas relações não lhes oferecem mais do que alguma protecção social, pese embora a crescente preocupação do legislador em regular a União de Facto. Na verdade, os membros da União de Facto podem beneficiar de alguns direitos semelhantes aos dos cônjuges, mas ao contrário do que sucede noutros países, não estão equiparados a eles.Com efeito, a presente dissertação propõe a possibilidade de os membros de uma União de Facto poderem regular os efeitos patrimoniais das relações entre eles e com terceiros, através de um contrato, sujeito a registo.Para tanto, procederemos à análise da União de Facto e do casamento, bem como dos respectivos efeitos de cada um. Depois, faremos uma sucinta referência ao direito comparado, e também aos contornos do veto presidencial do Decreto-Lei n.º 349/X, que visava a atribuição de alguns efeitos de ordem patrimonial aos membros da União de Facto. Por fim, faremos uma proposta de regulamentação dos efeitos patrimoniais da União de Facto, através de um contrato, sujeito a registo, atribuindo-lhes alguns direitos semelhantes aos dos cônjuges, por forma a oferecer-lhes uma maior segurança jurídica, e também àqueles que com eles contratem.
