Abstract: Surrogate mother is the one who is pregnant due to Medically Assisted Procreation techniques, with the aim of delivering the baby to a contracting couple, renouncing to all parental rights. According with subtypes, the surrogate mother may, or may not, have a genetic bond with the child. This paper intends to revise the surrogate mother issues, approaching various points of view on this theme that can be grouped in three major spheres: the ethical, the legal and the social/family aspects. This work was developed under the Ethic scientific area and starts by analyzing the Ethical Principles implied in Medically Assisted Procreation, as well as the Women's Rights, that may be evoked in this discussion. The legal approach is carried out in the terms of a Surrogacy agreement, currently null and punishable under the Portuguese law, namely in the foreseen clauses and the legal scenery in many countries. The controversy stresses in the form of the agreement – free or onerous. The potential exploitation of economically disadvantaged women seems to be highlighted by the emerging “reproductive tourism”, since the prohibition does not seem to prevent the quest and the achievement of Surrogacy agreements. In the social and family sphere, we intend to understand the motivations of both parties – contracting couple and surrogate mother – as well as a wide range of possible problems. Surrogate mothers are at risk of suffering psychological damages when the baby is handed out, although most women describe Surrogacy as a positive experience. In addition, these women seem to undergo possible medical and family complications. The child is the most important link of this process, as his/her interests are above all of the other elements'. Among the fear of the violation of fundamental rights and the comparison with the adoption process, there are referred the consequences that may result from a Surrogacy agreement. Social acceptance and the redefinition of family concepts still constitute a challenge in Surrogacy, regardless of the persisting problem of the appearance of a “baby market”. Finally, there are referred special cases of this reproductive modality, which include intrafamily agreements, with homosexual couples or individuals, as well as the birth of a handicapped child. This new reproductive modality, currently under discussion by the Portuguese parliament, demands deep and attentive social and cultural thought, based on the study of Ethical Principles.
Mãe de Substituição é aquela que engravida com recurso a técnicas de Procriação Medicamente Assistida, com o intuito de entregar o bebé a um casal contratante, renunciando a todos os direitos parentais. De acordo com os subtipos, a mãe de substituição pode, ou não, possuir um vínculo genético com a criança. Este trabalho pretende fazer uma revisão sobre Maternidade de Substituição, abordando os diferentes ângulos deste tema, que se podem agrupar em três grandes esferas: os aspetos éticos, legais e sócio-familiares. Este trabalho, desenvolvido na área científica de Ética, começa por analisar os Princípios Éticos implicados na Procriação Medicamente Assistida, assim como os Direitos das Mulheres, que poderão ser invocados nesta discussão. A abordagem legal é feita nos termos do contrato de Maternidade de Substituição, atualmente nulo e punível pela lei Portuguesa, nomeadamente nas cláusulas previstas e o panorama legislativo nos diversos países. A controvérsia acentua-se quanto às modalidades do contrato – gratuito ou oneroso. A possibilidade de exploração de mulheres economicamente desfavorecidas parece acentuar-se com o aparecimento do “turismo reprodutivo”, uma vez que a proibição parece não impedir a procura e concretização de contratos de Maternidade de Substituição. Já na esfera sócio-familiar, pretende-se compreender as motivações de ambas as partes – casal contratante e mãe de substituição –, assim como toda uma panóplia de possíveis complicações. As mães de substituição estão em risco de sofrer danos psicológicos aquando da entrega do bebé, apesar da maioria descrever a Maternidade de Substituição como uma experiência positiva. Para além disso, estas mulheres parecem estar ainda sujeitas a possíveis complicações médicas e familiares. A criança constitui o elo mais importante deste processo, pois os seus interesses sobrepõem-se aos dos outros elementos. Entre o receio da violação dos seus direitos fundamentais e a comparação com o processo adotivo, são referidas as consequências que podem resultar de um contrato de Maternidade de Substituição. A aceitação social e a redefinição dos conceitos familiares constituem ainda um desafio na Maternidade de Substituição, apesar de se manter a problemática quanto à possível criação de um “mercado de bebés”. Por fim, são ainda referidos casos especiais nesta modalidade reprodutiva, que incluem os contratos intrafamiliares, com casais homossexuais ou indivíduos singulares, assim como o nascimento de uma criança com deficiência. Esta nova modalidade reprodutiva, que se encontra atualmente em discussão parlamentar em Portugal, exige uma reflexão sócio-cultural profunda e atenta, com base no estudo dos Princípios Éticos.
