O conceito de operação urbanística do RJUE e a sua aplicação no âmbito de certos regimes referentes ao exercício de certas actividades económicas.

Abstract

Por vezes, levantam-se problemas relativos ao exercício de actividades económicas, nomeadamente, aquando da sua instalação e funcionamento. Deste modo, é essencial fazer uma articulação de dois regimes: um relativo ao exercício das actividades económicas e outro que concerne às operações urbanísticas necessárias à sua instalação e exploração, que por sua vez, estão sujeitas a procedimentos de controlo preventivo que constam do RJUE. Neste âmbito, serão abordados os regimes jurídicos que regulam as actividades económicas, nomeadamente: as de comércio, serviços e restauração (consagradas no RJACSR) e as industriais (dispostas no SIR) e a sua articulação com o Regime Jurídico de Urbanização e Edificação.No RJUE está inserida a definição de operação urbanística e, consequentemente, os procedimentos de controlo a que esta está sujeita. No exercício de certas actividades económicas, nomeadamente, no momento da sua instalação, há lugar a realização de operações urbanísticas. Como tal, é necessário haver uma articulação dos dois regimes em causa, para que não hajam dúvidas acerca da sua legalidade. O tema deste trabalho detém como pano de fundo, o Regime Jurídico da Urbanização e Edificação (RJUE). Como tal, o trabalho recai sobre os pressupostos que nele estão descritos, mais propriamente, em relação aos elementos atinentes á realização de operações urbanísticas e, consequentemente, aos procedimentos de controlo preventivo a que estas estão sujeitas. Acontece que, por vezes, surgem problemas que se levantam quando, por causa da instalação de actividades económicas, nomeadamente, de comércio, serviços, restauração e bebidas ou indústria, haja lugar a realização de operações urbanísticas, já que muitas vezes, as entidades tendem a confundir os distintos procedimentos que é necessário desencadear. Nesse âmbito, há necessidade de definir e articular cada um dos regimes em causa, de forma a que não haja dúvidas de como actuar quando estas situações ocorrem. Pretende-se, assim, neste relatório definir os termos e os modos do relacionamento destes procedimentos de forma a orientar as entidades que têm de intervir neste domínio.

The theme of this assignment has as background the Juridical Regime of Urbanization and Edification.This paper reflects on the presuppositions described in the juridical regime specifically regarding the elements that concern urbanistic operations and, consequentially, the procedures of preventive control to which they are subjected to.So it happens that, sometimes, problems may emerge when, because of economic activity installation, namely commerce, services, food and drink businesses or industry, the realization of urbanistic operation occurs since, often, the entities tend to confound the various procedures which are necessary to initiate. In this field, there is a need to define and articulate which one of the regime in a way where there is no doubts on how to act when these situations occur.Thereby, it is our claim to define the terms and the ways to relate this procedures so to guide the entities that have to intervene in this domain.In the RJUE is inserted the definition of urban operation and, consequently, the control procedures to which it is subject.In the course of certain economic activities, in particular, at the time of its installation, there is a city planning operation. As such, it is necessary to have an articulation of the two schemes concerned, so that there is no doubt as to its legality.Problems arise in connection with the exercise of economic activities, in particular when they are installed and operated.It is therefore essential to coordinate two schemes: one relating to the pursuit of economic activities and the other relating to the town-planning operations necessary for their installation and operation, which in turn are subject to preventive control procedures contained in the RJUE.In this context, the legal regimes that regulate economic activities, namely: trade, services and catering (established in RJACSR) and industrial ones (set out in the CRS) and its articulation with the Legal Regime of Urbanization and Construction will be addressed.
