EUTANÁSIA E AS QUESTÕES JURIDICO-PENAIS: Direito a uma morte digna/ética ou crime?

Abstract

O trabalho em questão versa sobre a eutanásia, seu conceito e espécies com o objetivo de tratar sobre a dignidade da pessoa humana. Este estudo pretende abordar uma questão teórica sob o ponto de vista jurídico-penal em Portugal e no Brasil mesmo ambos países não tendo uma legislação específica sobre o assunto, tratando por equiparação ao crime de homicídio na sua versão privilegiada, com diminuição de pena. Também será realizada uma abordagem ética e religiosa uma vez que alguns países tipificaram o ato como legal, outros são omissos e alguns consideram crime. Primeiramente pretende-se esclarecer o conceito da vida e morte humana com dignidade, passando por conceito de ato médico e os limites do consentimento, assim qual o limite da autodeterminação?. Posteriormente far-se-á um estudo teórico sobre a eutanásia, passando pela sua definição, conceito histórico, classificações (eutanásia direta, indireta e passiva) para, em seguida, analisar à luz do Direito Penal português, brasileiro e outros países da Europa como esse ato é tratado. Por fim explicar como é seu tratamento nas questões religiosas como budismo, islamismo, judaísmo e cristianismo, dentre elas, a única que não tem a vida como bem maior é o budismo. Nesse contexto há uma questão a ser feita: A eutanásia é um direito a uma morte digna ou é um crime? Portanto, será investigado os fatores que criminalizam a eutanásia e as consequências da sua legalização como o elevado números de pessoas que procuram esse meio para dar fim a sua vida.

The work in question deals with euthanasia, its concept and species in order to deal with the dignity of the human person. This study intends to address a theoretical question from a criminal-legal point of view in Portugal and Brazil even though both countries do not have specific legislation on the subject, treating as equating to the crime of homicide in its privileged version, with reduced sentence. An ethical and religious approach will also be undertaken since some countries have typified the act as legal, others are silent and some consider it a crime. Firstly, it is intended to clarify the concept of human life and death with dignity, passing through the concept of a medical act and the limits of consent, thus the limit of self-determination ?. Later, a theoretical study on euthanasia will be carried out, including its definition, historical concept, classifications (direct, indirect and passive euthanasia), and then analyze it in the light of Portuguese, Brazilian and other European Criminal Law as This act is dealt with. In order to explain how it is treated in religious matters such as Buddhism, Islam, Judaism and Christianity, among them, the only one who does not have life as a greater good is Buddhism. In this context there is a question to be asked: Is euthanasia a right to a worthy death or is it a crime? Therefore, we will investigate the factors that criminalize euthanasia and the consequences of its legalization as the high numbers of people seeking this means to end their life.
