dc.description.abstractA matéria a que me proponho versará sobre a Pena Relativamente Indeterminada, a problematização da mesma e as soluções apresentadas às críticas formuladas. Os comportamentos criminosos desde sempre preocuparam as sociedades e evoluem ou transformam-se em conjunto com estas. Desta forma, o Direito Penal torna-se cada vez mais uma matéria em que a interdisciplinaridade é fundamental para a busca de explicações e soluções cada vez mais eficazes para o combate e prevenção de uma sociedade manchada. Esta reação criminal é relativamente inovadora por existir, sobre esta designação, em Portugal, fugindo de forma mais ou menos evidente às solvências encontradas por outros países para um grupo de indivíduos que, por alguma razão, inata ou não, não se comporta de forma habitual conforme o direito: os delinquentes por tendência. Adiantando, desde já, que existem vários tipos de delinquência tendente e que, em virtude disso, a pena relativamente indeterminada terá não uma execução diferente consoante o caso, antes se encontrará variável nos seus limites mínimo e máximo - portanto, na sua moldura penal abstrata.«O nosso sistema é de certo monista no sentido de não permitir a aplicação ao mesmo agente, pelo mesmo facto, de uma pena e de uma medida de segurança complementar privativa da liberdade. Ele é, todavia, dualista, não só no sentido de conhecer a existência de penas e de medidas de segurança, mas também no sentido de aplicar medidas de segurança não detentivas a imputáveis (artigos 100.º e ss) como ainda no de aplicar cumulativamente no mesmo processo, ao mesmo agente, embora por factos diversos, penas e medidas de segurança.» Iniciando o estudo na análise do sistema jurídico-penal português à luz das finalidades das penas e da dicotomia monismo / dualismo, passando por considerações iniciais da necessidade da implementação de uma medida como a pena relativamente indeterminada na nossa filosofia penal, terminando com uma análise prática da aplicabilidade da mesma entre nós, representa o caminho que será seguido nesta investigação.Há ideias que estarão sempre presentes ao longo deste desenvolvimento, principalmente a partir do Capítulo III, tais como o facto de a pena relativamente indeterminada assumir-se, na prática, como uma execução conjunta de uma medida de segurança e de uma pena, cuja prorrogação só se justifica em função da perigosidade criminal do agente.por
dc.description.abstractMy theme will be about the Relatively Indeterminate Penalty, the problematization of it and the solutions presented to the criticism formulated. The criminal actions have always worried societies and evolve or change in tandem with them. In this way, Criminal Law becomes increasingly a matter in wich interdisciplinarity is fundamental for the search for explanations and solutions increasingly effective for the combat and prevention of a stained society. This criminal reaction is relatively innovative because it exists, on this designation, in Portugal, escaping in a more or less evident way to the solvency found by other countries for a group of individuals who, for some reason, innate or not, doesn't behave in a habitual way according to the law: delinquents by trend. It should be pointed out that there are several types of delinquent tendencies and that, as a result, the relatively indeterminate punishment will not have a different execution depending on the case, but rather will be variable in its minimum and maximum limits - hence in its abstract penal framework.«Our system is rather straightforward in that it does not allow the application to the same agent of a penalty and a supplementary security measure involving deprivation of liberty. It is, however, dualistic, not only in the sense of knowing the existence of penalties and security measures, but also in the application of non-custodial security measures (Articles 100 et seq.) cumulatively in the same process, to the same agent, albeit for various facts, penalties and security measures.» Beginning the study in the analysis of the Portuguese penal-law system in the light of the purposes of penalties and the monism / dualism dichotomy, necessity of implementing a measure such as the relatively indeterminate sentece in our criminal philosophy, ending with a practical analysis of the applicability of the same between us, represents the path that will be followed in this investigation.There are ideas that will always be present throughout this development, especially from Chapter III on, such as the fact that the relatively indeterminate sentence will in practice be taken as a joint execution of a security measure and a sentence, whose extension can only be justified by the criminal danger of the agent.eng
