O cabo das tormentas da União Europeia : a (difícil) adesão à Convenção Europeia dos direitos humanos

Abstract

O processo de positivação dos direitos fundamentais na União Europeia plasmouse pela morosidade no reconhecimento da importância dos mesmos pelos Tratados fundadores e pelo caráter pretoriano da jurisprudência do Tribunal de Justiça das Comunidades. Mais tarde, com a aprovação da Carta dos Direitos Fundamentais da União Europeia, apresentava-se um modelo original e ambicioso da proteção dos direitos fundamentais a todos os Estados-Membros, sendo relegada para tratamento posterior a anciã questão acerca da adesão à Convenção para a proteção dos Direitos do Homem e das Liberdades Fundamentais. Depois do malogrado Tratado Constitucional, a entrada em vigor do Tratado de Lisboa, conferindo força jurídica vinculativa à Carta dos Direitos Fundamentais da União Europeia, marcou somente a adesão material a este instrumento internacional de proteção dos direitos fundamentais. A adesão formal projetada pela Comissão Europeia em conjunto com o órgão ad hoc do Conselho da Europa, após o parecer negativo do Tribunal de Justiça da União Europeia, continua a aguardar por melhores ventos. Abstract The positivation process of fundamental rights in the European Union shaped by the slowness in recognizing the importance of them by the founding Treaties and the praetorian nature of the case law of the Court of Justice. Later, with the approval of the EU Charter of Fundamental Rights, it presented an original and ambitious model of protection of fundamental rights for all Member States, being relegated for further treatment elderly question about the accession to the Convention for the protection of Human rights and Fundamental Freedoms. After the ill-fated Constitutional Treaty the entry into force of the Lisbon Treaty, giving binding legal force to the EU Charter of Fundamental Rights, only marked the accession material to this international instrument of fundamental rights protection.
