Abstract: RESUMO: O presente trabalho pretende realizar um estudo da discricionariedade normativa das entidades reguladoras, mais precisamente da problemática do controlo judicial sobre as mesmas. Pareceu-nos redutor olhar para esta questão apenas no seio do direito português e, por esse mesmo motivo, recorremos ao estudo de direito comparado, com especial enfoque nos países de common-law, tendo sido este uma ferramenta muito significativa na nossa análise. Contudo, não foi apenas o estudo do direito norte-americano e de outros países Europeus que nos serviu de base. A componente legislativa e jurisprudencial foi um elemento fundamental na construção do nosso trabalho. Com esta dissertação pretendemos evidenciar o facto de se tratar de uma temática que não reúne consenso, propagando-se no tempo a sua discussão. Foi, sobretudo, no seio do direito norte-americano que se recorreu a diversos tipos de controlos não judiciais, para que exista uma fiscalização mais forte sobre as entidades reguladoras. Contudo, a questão que se coloca é se esses métodos terão sido suficientes. É relativamente a esta questão que apresentamos uma proposta de resolução para a problemática do desconhecimento técnico e cientifico dos juízes, no seio dos tribunais quer administrativos e fiscais, quer judiciais. ABSTRACT: This present work aims to study the normative discretion of independent agencies, more precisely the issue of judicial control regarding these agencies. At first glance, this issue is rather limited within the Portuguese law, and for this very reason, was decided to also make use of the comparative law study, paying special attention to the common-law countries, making this tool a very significant one to the success of this analysis. However, the foundations for this study weren’t just the northamerican law and other European countries. The legislative and judicial components were also assessed, making them a key asset for the development of this work. With this thesis it is aimed to highlight the fact that this is a subject that, up to this day, still doesn’t gather a consensus thus extending its discussion. In order to have a stronger control regarding Independent Agencies, it is often resorted to the use of different types of non-judicial control, mainly amongst the north-american law. Nevertheless, the main question that arises is whether the methods in use are suitable. So, it is mainly regarding this matter that a resolution proposal over the issue of the technical and scientific unawareness of the courts and judges is presented, amidst not only the administrative and fiscal courts but also the judicial courts
