As reformas previdenciárias (necessárias) segundo os princípios da sustentabilidade e da justiça intergeracional : um estudo dos sistemas português e brasileiro

Abstract

A presente pesquisa tem o objetivo de analisar as reformas previdenciárias nos ordenamentos jurídicos português e brasileiro, sob a perspectiva dos princípios da sustentabilidade e da justiça intergeracional. Inicialmente fizemos a análise da reconstrução da socialidade influenciada pelo formato do Estado Social no século XXI, além de explorar todas as dimensões e sentidos do princípio da sustentabilidade e o entendimento da responsabilidade perante as futuras gerações, protegidos pelo princípio da justiça intergeracional. Seguimos pela esquematização dos sistemas de segurança social português e brasileiro, de acordo com a previsão constitucional e a atual estrutura dos sistemas, regulamentada por legislação complementar. No derradeiro capítulo foram analisadas as principais reformas previdenciárias aplicadas, desde a consagração das Constituições vigentes em Portugal e Brasil, com as devidas considerações acerca do novo cenário de desafios e dificuldades em arena global, como a evolução demográfica e as mutações que constituíram a nova ordem econômico-financeira no mundo. ABSTRACT This research aims to analyze the pension reforms in the portuguese and brazilian legal systems, from the perspective of the principles of sustainability and intergenerational justice. Initially we did the analysis of the reconstruction of sociality influenced by the welfare state shape in the twenty-first century, and explore all dimensions and directions of the principle of sustainability and understanding of responsibility towards future generations, protected by the principle of intergenerational justice. Followed by the drafting of the portuguese and brazilian social security systems, according to the constitutional provision and the current structure of the systems, regulated by complementary legislation. In the last chapter were analyzed the major social security reforms implemented since the consecration of the Constitutions in force in Portugal and Brazil, with the necessary considerations about the new scenario of challenges and difficulties in the global arena, such as demographic change and the changes that constitute the new order economic and financial in the world
