Longe de casa, longe da justiça? : o acesso à justiça por parte dos refugiados

Abstract

O trabalho desenvolvido ao longo desta dissertação diz respeito à realidade atual da situação dos refugiados e requerentes de asilo. A efetivação dos direitos humanos destes não poderá afirmar-se sem que exista um efetivo acesso à justiça. Através da análise dos instrumentos de direito internacional, determinantes para a definição das obrigações do Estado para com os refugiados e dos seus direitos fundamentais, compreendemos os mecanismos em utilização para que a garantia de um direito à justiça efetiva, ao mesmo tempo que apontamos as lacunas existentes nessa legislação. Esta dissertação debruça-se sobre alguns momentos essenciais na vida dos refugiados e requerentes de asilo, em que existe uma maior vulnerabilidade e, consequentemente, momentos em que será necessária a aplicação de mecanismos garantísticos e um efetivo acesso à justiça para que sejam assegurados os direitos fundamentais. Abstract The work developed throughout this dissertation refers to the present situation of refugees and asylum seekers. The effective realization of Human Rights is not possible without an effective access to justice. Through the study of international law instruments, that are crucial to the definition of States obligations towards refugees and towards their fundamental rights we are able to understand the mechanisms in use so that access to justice can be guaranteed, while we point out faults in the legislation. This dissertation refers to essential moments in the life of refugees and asylum seekers, where a special vulnerability is evident. Accordingly, in these moments there is a special need for the application of effective mechanisms to access justice so that fundamental rights can be assured
